How can I sue the HR manager for harassment and false accusations over the phone?

Hello,

My HR sent me a WhatsApp accusing me of things that didn't happen. She sent me WhatsApp during the weekend and her accusations were rude and this affected me as I am diabetic.

Can I sue her for that?

Your question is very general. What exactly are the words?

23 Jan 2024, 09:09

Well, I was asked to help advertise for an opening at our school.

Did so and got applicants.

I used LinkedIn and got the CVs through the website, downloaded them, and shared them with HR and VP.

A few days after, during the weekend, she accused me of using my personal email and getting the CVs directly and what I did was fraud.

There was no questioning about how the CVs reached or anything. Direct accusations.

You have the right to complain to the police and claim that this woman insulted you, saying about a person that he cheated, is considered an insult.

Police may accept or reject the complaint. Depends on the officer in charge there. If he refuses, the complaint can be submitted to the public prosecution.

Of course, you should think about your position in the company after that.

Thank you for this, does this have a time frame to be filed?

Within how many days of receiving the message am I eligible to file a complaint?

23 Jan 2024, 09:58

3 months from the date of the text message.

In cases of insult, it is not important that the words said are true or false, what matters is that what was said is an insult or not.

If someone says to a very fat person, "You are very fat", it is considered an insult, even though he is really very fat.

So in your complaint, do not talk about the correctness or incorrectness of what that woman said about you, and let your focus be only on the insult.
