Q: Reviewing this article and UAE FL 18 of 1993, Article 95 CTL states 10 years for commercial obligations between bank and person (trader):
I would like to know if the statute of limitation (time-bar) can be brought up in court for defence if the verdict by the initial court is issued in 2010 (10+ years ago) and nothing has paid by the debtor after the execution of the verdict.
Exp: If a case has a time table like below, can the defendant still use the law in relation to time-bars?
- Case opened in the UAE initial commercial court: 2010
- Case reached a verdict in absentia (UAE commercial initial court): 2010
- Case is sent to Execution court and remained there ever since: 2012
If nothing has changed and no payment is made, am I right to assume that after 10 years (2021), this claim is time-barred and the defendant can use the statute of limitation as his defence with the debtor?

Claiming unpaid fees for services provided to a company

Q: Respected Sir / Ma'am,
I am an IT service provider. I got a project from one of the companies in Abu Dhabi to perform a System Implementation.
I have completed the project and have raised the invoice for the same, but the customer is not paying the amount. It amounts to about 30000 USD.
I am calling for a Steering Committee meeting as per the contract/proposal terms to resolve the issue of not paying me. The IT team, to whom I am reporting is just not letting the Steering Committee meeting to happen.
I have other projects running in parallel with the same client. I have issued a "Credit Hold" and stopped all activities with proper notice and have all details on email communication. Still, they are not calling for a meeting / trying to resolve the issue...
What are my options to recover the amount? If at all I have to hire a lawyer, what will be the costs for the same?
Would appreciate your advice/recommendations greatly.

Q: Dear Sir/Madam,
How can we get a company to pay us for the services provided?
We are a medical center in Abu Dhabi that provided round-the-clock PCR services to the staff of a Marine company in Abu Dhabi between July and November 2022.
The credit period for payment has expired more than 4 months ago, and the company has not provided any updates regarding our outstanding payment of over 100,000 AED.

Can I put a financial guarantee to remove a travel ban in a rental case at RDC? 0
I used to work as a manager in a company, and my name was removed by the Dubai court of execution.
Now, on the paid rent, I got a travel ban, which I objected to at RDC.
The RDC accepted and gave the next hearing date, as I will have all the court papers.
Is there any way to remove the travel ban, as the objections I made at the execution hearing are next month, almost one month?
Is there any way you can put the amount as a deposit, and once the objection case is over, you can take it back?

Hi there,
My husband and I are Muslims. My husband passed away recently.
We have a Canadian will, but I understand that it won’t be honored as I am named the sole beneficiary, and that does not align with Sharia laws in the UAE. He was not a UAE resident but had a small apartment with no Will in the UAE.
We have 3 children. I am planning to go to Dubai to start an inheritance case. I don’t know the exact order of events and what needs to be done first.
1) Do I initiate anything from overseas before making travel plans to Dubai, or do I start once I arrive in Dubai?
Mind you, we cannot afford to stay in Dubai for too long, as the kids have school.
2) Do I need a lawyer, or can this be done by myself?
3) I understand all foreign documents need to be authenticated before presenting them to the court. But I don’t know at what stage I would need these documents authenticated.
I would appreciate it if you could provide a breakdown of the steps, the forms that are needed, and where I can find them.
