Questions & Answers
Terminated without warning. Eligible for 3 months' compensation?
Dear Sir/Madam,
I was terminated without receiving a written warning, and the reason given is that I don't perform my basic duties, which is definitely not true.
I had just submitted a local leave, and the day after, the termination letter was sent to me via email along with the approved leave.
Am I entitled to 3 months of compensation for arbitrary termination? My contract is for 3 years.
Dear Questioner,
Terminating employees depends on the contract type and reason for dismissal.
Unlimited contracts require notice (30-90 days) for any valid reason, while limited contracts require specific reasons like misconduct or redundancy.
Employers can fire without notice for gross misconduct, negligence, absence, or false information, but must follow documented procedures and may owe notice pay and gratuity in some cases.
For additional clarification, it is necessary to examine the labor contract.
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
If your employment contract states that termination requires a written warning and the reason given for termination is not valid, you may have a case for arbitrary termination.
In such cases, you may be entitled to compensation equivalent to three months' salary as per UAE labor laws.
It's advisable to consult with the Ministry of Human Resources and Emiratisation (MOHRE) to understand your rights and take appropriate action.

Dear Questioner,
A termination can be considered an illegal one if it qualifies for some criteria under the amended UAE Labor law.
Apart from that, it should be specifically mentioned in the employment contract.
Furthermore, issuing a warning letter will be at the discretion of the company according to their management policy and according to the seriousness of the situation.
If you need further clarification, we will arrange a legal consultation session for a charge.

Dear Sir,
In this regard, you will have to raise a complaint of arbitrary dismissal against the employer in the Ministry of Human Resources and Emiratisation.
The Ministry will then try for an amicable settlement, failing which the matter will be referred to the courts.
If arbitrary dismissal is proven, the court will order the employer to pay compensation, which is determined by the court by considering the type of work, extent of damage caused, and duration of your service.
However, such compensation cannot exceed your three months' wage.
