Filing a civil case for recovering a bounced cheque amount
Hi,
I have filed a case against my client for the returned cheque of 45k. He got released after paying a fine.
How can I file a civil case and which department should I approach?

Dear Questioner,
I assume you are based in Dubai. I appreciate your initiative of filing a criminal complaint in the police station.
You have not mentioned if this cheque is a personal one or a commercial one [issued by a company] based on invoices and LPOs.
Please note that you may file the case in Dubai Courts. You will have to pay a court fee @ 6%.
During the hearing, you will have translate and submit all the records pertaining to this transaction. I mean the documents to prove why this amount was due and what is the basis of the transaction and all related details.
The court will send summons to the other party to attend the hearing and will also give an opportunity to the other party to defend the case.
If the other party fails to attend even after receiving the notification from the Court [or after the publication made in the news paper], the Court may award an ex parte judgement.
Hope the above explanation gives you a brief idea on the Court procedures during a civil case. Please let me know if you need any legal assistance or any further information on the same.
