The owner is avoiding repairs due to selling the property. What to do?

Dear All,

I am renting a villa in Dubai. The water heater stopped working and needs to be changed. We do not have hot water in the house.

After receiving quotations from several companies, the owner is avoiding the repair as he is selling the property. I would like to know the legal procedure in RDC to address the damages.

Thank you very much!

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

If you find that the water heater in the villa you are renting is not functioning properly and your landlord is unwilling to address the issue, here's what you can do:

- First, make sure to inform your landlord in writing about the problem.

- Next, carefully review your lease agreement to see if there are any clauses regarding maintenance responsibilities.

If the matter remains unresolved, it would be advisable to get in touch with the Rental Dispute Center (RDC), in Dubai. Provide them with all the documents.

They will attempt to mediate between you and your landlord. In case mediation proves unsuccessful, the RDC has the authority to issue a judgment that requires your landlord either to carry out repairs or provide compensation.

Remember to keep records of all communication and document the issue by taking photographs as evidence.

Dear Questioner,

Review your lease agreement to understand the responsibilities of the landlord and tenant regarding property maintenance and repairs.

Lease agreements in Dubai typically outline the terms and conditions that govern such matters.

After that, send a formal letter to the landlord if he is responsible for the repairs and maintenance.

If there is no satisfactory reply, you can file a complaint.

Dear Questioner,

The landlord is responsible for fixing these amenities according to rental law in Dubai. If he didn't, you have to file a complaint with the RDC.

The procedure will be discussed in a legal consultation for a charge of 28$.
