Q: Hello.
Mr R. and Mr Z. are founders of a company located in Ajman. They are buying my fish from Indonesia.
The total amount of 2 invoices is USD 11.074, but they paid me just USD 5.000 since 8 months ago.
Can you help me to collect my balance?

Recourse for unpaid dues in commercial transactions

Q: I am a contractor and my client has pending payments with him. I have received 5 out of 13 payments I sent him.
All the 13 payments are late. All the payments have been signed and approved and he gave me a payment certificate to confirm due date of payment but until this date, it is not paid.
Each certificate is delayed out of the 8 balance. They range in delay from 2 weeks to 6 months. What are my rights and the damages I can claim as per the UAE law?
Please note that I had to close down my business because I can't afford to run it due to the late payments.

Recovery of due amounts for products supplied to a hotel

Q: Dear Sir,
We are a manufacturer of hotel supply product which locates in Bangkok, Thailand.
We did export to a company in Dubai and allowed them to clear custom already. However, they have not paid to us for a total amount of USD 46,369.16 until now.
They are SME Award company and they are a member of Chamber.
We asked our Thai Consulate to call them. They still refuse to pay.
We would like to hire a collection agency in Dubai, but we worried that if we pay upfront for issuing a legal notice, we still don’t get money.
Please advise if we should sue through the chamber or appoint a collection agency.
If we appoint a collection agency, how can we make sure that we will get money back after paying an upfront fee?

Commercial recovery case for the non-payment of invoice

Q: Hello,
One of my clients in Dubai has not paid our invoices from the last 6 months.
Even after agreeing to a payment schedule, they have missed the second payment and delayed it.
I have all the emails and signed PO number too. I would like to seek legal advice to end this misery.

Recovery of outstanding dues against a supermarket

Q: We were selling our food items regularly to one big supermarket having 3 to 4 branches in Dubai for the last 10 years and were paying our bills within 90 days.
Suddenly, for the last 1.5 year, they started delaying payment and rather not paying since 1 year for goods worth more than AED 100,000/-.
We stopped selling goods to them for 4 months as not paid for previous bills. We follow up every week but they're not paying.
How can we take legal action against them or complain to the government authorities like the Economic Department or others?
Please guide us.

Imported materials are proven to be faulty. What to do?

Q: Dear sir/madam,
Any advice on this situation?
We have imported materials from an international supplier (China). The materials got rejected after installation due to manufacturing defects (which is proven from a third-party report) and the supplier is not accepting their defects nor involving in resolving the issue.
What legal options do we have as buyers to bring them to the table to resolve or compensate?
Note: the supplier doesn’t have a representative/office here in the UAE.

Our trading company provided material to another company and got a bounced cheque

Q: Hello,
We are a trading company. 8 months ago, we delivered material to a customer and took a security cheque with the date 09-June-2022.
The day passed and the customer did not make our payment, we deposited the cheque in the bank after the due date and it bounced.
Please let us know the legal way to claim the amount which is more than AED 200,000.
There is a stamp also for the security cheque on the back side of the cheque.

I worked in my company for 8 years and was terminated on the same day specifying redundancy as the reason. The company paid me all the dues (1 month notice period salary, gratuity, and unpaid leave salary).
I want to know if I am eligible for 3 months termination salary benefit considering none of the other employees were terminated?
