Questions & Answers
Imported materials are proven to be faulty. What to do?
Dear sir/madam,
Any advice on this situation?
We have imported materials from an international supplier (China). The materials got rejected after installation due to manufacturing defects (which is proven from a third-party report) and the supplier is not accepting their defects nor involving in resolving the issue.
What legal options do we have as buyers to bring them to the table to resolve or compensate?
Note: the supplier doesn’t have a representative/office here in the UAE.

Dear questioner,
If the opposite party has no office here, you must file a dispute in the country of their establishment.
You can also try sending a legal notice first.

Dear questioner,
You need to file a case against the supplier here and then execute it in China.

Dear questioner,
This issue can be resolved by mediation or negotiations. If not, then we have to check the contracts between your company and the supplier, if an arbitration clause is there, we would have to initiate the arbitration procedures.
If not, we can sue in China directly through our international relationships.
