How to renew a tenancy contract while an eviction notice was issued earlier?

Dear Sir/Madam,

I issued an eviction notice to the tenant to sell the house. At the same time, I obtained a rent valuation certificate from the Dubai Land Department (DLD).

The tenant is now willing to sign a one-year contract at the increased rent.

Should I sign the contract, and what will happen to the eviction notice, which requires the tenant to vacate the property by August 2, 2024?

What do you want?

Do you want him to continue living on your property, or do you want him to vacate the property in August 2024?

I want the tenant to continue to live if she signs a one-year contract.

An eviction notice is for your benefit, and as long as you don't want the tenant to vacate, that's up to you.

In order not to have any problems with him in the future, you can send him an official notice canceling the eviction notice.

Dear Questioner,

First, you sign the Ejari and then withdraw the notice, or you may add an additional clause in the Ejari agreement for withdrawing the notice.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

If the tenant agrees to a new one-year contract at the increased rent, you can proceed with it.

However, doing so would typically mean withdrawing the previous eviction notice, as the tenant is willing to continue the tenancy under the new terms.

Ensure the updated terms are well-documented in the new contract.

Dear Questioner,

If you want to renew the contract, you can do so. But after the notice period you renew the contract, the eviction notice will be no longer valid.

If you want to evict him, you have to send another eviction notice for 12 months.

If you need further clarification, we will arrange a legal consultation session for a charge of 28$.

Hi,

According to your query, it is up to you if you want to sign another contract.

Once you sign the new contract, the earlier eviction notice will become invalid.

Hello,

I understand from your question that you have sent an eviction notice to the tenant with a 12-month notice period and that this period will end on 2/8/2024.

You are compelled to renew the tenancy contract according to the agreed-upon increase. Does signing the contract renewal affect the eviction notice you sent?

The answer is no. Renewing the tenancy contract does not impact your right to file an eviction lawsuit when the notice period expires, provided the eviction conditions are met.

The tenancy contract automatically renews whether you sign it or not.
