Should I sign a new contract or extend my current one to meet the eviction date?

Hello,

My tenancy contract ends on August 9, 2024, but I received an eviction letter last December. Therefore, I submitted a request to extend the eviction until December 11, 2024.

My question is whether I need to sign a new contract for 4 months and 2 days or extend the old tenancy contract. Also, should I create a new Ejari for this period?

I want to be covered in case I need to dispute next year (in case the landlord rents it at a higher price, which is likely).

If I sign a new contract for 4 months and 2 days, will I still be eligible to dispute next year if the landlord rents it to someone else?

Thanks!

Hello,

Regarding your tenancy situation, as a tenant who has received an official eviction notice, you have the option to vacate the property at the end of the notice period or stay until the landlord obtains a court order for eviction.

In any case, if you find out that the landlord has re-rented the property to others, you can claim compensation, and the duration of the contract extension, whether for a year or four months, does not affect this. The contract is legally considered extended.

I advise you to always communicate with the landlord about renewal, eviction, or any other matters through email.

Always confirm in your communications that you will vacate the property based on the official eviction notice received from the landlord.

If you need further assistance, feel free to ask.

Thank you for your answer!

So I can sign a new contract (4 months and 2 days) and it will be considered an extension, correct?

Also, for that period, should I issue a new Ejari?

Yes, you can agree on any duration for the contract and obtain an Ejari for the same period.

Hello,

You have to enter into a new contract with the landlord to secure your rights.

You can file a dispute against this landlord based on evidence, including the Ejari contract. You are renewing the contract just to align with the eviction notice, so it will support your claim.

If you need further clarification or assistance, kindly share your WhatsApp number.

Dear Questioner,

The law states that only the new owner has the right to evict the tenant but with the following process:

The old owner needs to send you a legal notice for eviction, and then the new owner must give another notice with the same dates as the old one to emphasize it.

Conclusion:

If you did not receive any legal notice from either party, then do not vacate the premises. In general, do not evict unless there is a court judgment.

Given your situation, it's important to clarify the terms of your tenancy extension until December 11, 2024. You might negotiate an extension of the existing contract or sign a new short-term contract.

Ensure the terms are clearly documented and consider updating the Ejari registration.

Seeking legal advice specializing in tenancy laws can provide valuable protection and clarity on potential disputes.
