Q: I bought an off-plan property. After completion, I found out that the property didn't correspond of what I have signed in the SPA. I withdrew from the contract. The legal consultant of the company claims that I'm not entitled to have back my 4% which I have paid to DLD.
As I never became in possession of my property I am wondering if I can claim back my 4% which I have already paid due to the fact that the property under my name needs to be deregistered?

Q: Hello,
I have purchased a property in Dubai in May 2019 by putting a 25% deposit of the purchase price to the developer's escrow account and received the reservation form and payment receipts only.
However, I still do not have the SPA or OQOOD till now. The developer has been saying the SPA templates have been getting delayed.
As per the reservation form, I have an upcoming payment in Nov 2019. How I can validate that I have a legal reservation for the apartment and there is nothing to worry about?
What is my legal position here as I don't have any legal papers except the reservation contract which is only stamped from the developer but no OQOOD reference code/id/number or stamp on it?

Q: Signed a contract in Jan 2017. 4% DLD registration fees. The buyer 2%, seller 2%, the seller forged the invoice to pay 4%.
I should get a refund of the 2% paid extra.

Claiming back the fees paid to DLD after swapping a property with a different unit

Q: I purchased an off-plan property a couple of years ago from a Dubai based developer. After multiple delays, the developer has agreed to allow me to withdraw from the SPA and swap with another unit they are offering in another building that has been handed over.
As part of the cancellation, am I allowed to claim back the 4% fee I paid on the original property from DLD?

Q: Hello,
I have purchased an off-plan apartment in Dubai last year. I paid the deposit, Oqood registration fees, and have been paying all installments on schedule toward’s the developer's Escrow Account.
However, the developer is delaying issuing SPA or Oqood till now with no valid reason. Even though, they had me sign the SPA from my side on the promise that they’ll sign it after me and attest it from DLD.
It’s been more than a year now, I’ve been asking for either SPA & Oqood or a refund of my money, yet the developer simply replies with “it’s under process”.
I would prefer now to just terminate the agreement and get a full refund of my payments. Is this possible?

Is the buyer obliged to buy an off-plan property upon sign the booking form?

Q: Hello,
We wanted to buy an off-plan property. Unfortunately, the CEO of the developer ran away for financial reasons and RERA took over.
We only signed the booking form but none of our money has been taken. The SPA was also never signed.
Can we just move on and look at other properties or can RERA ask us to pay the amounts if they decide to choose another developer to finish the project?

Dear Sir,
My contract is a fulltime employee for a company in the UAE, and my leave entitlement state 10 weeks work and 2 weeks off.
However, due to the COVID-19, I have been unable to take that leave and have accrued two months leave or 61 days with four flight tickets.
My question is, can my company legally cancel those accrued days at the start of the new year or would they have to pay me for those days?

Good morning All,
I was terminated by my company in March 2020 for not signing the unpaid leave document given to me. I was terminated on 23rd March 2020.
Once termination letter was signed, ever since then, I have been chasing my ex-company for releasing the final settlement and each time they come up with a different plan.
The last option they gave was to sign an agreement with them for 6 months plan but are not giving me any guarantee cheques and insist that I sign the cancellation papers. I want to simply take my money and leave the UAE.
They have also directed me to their lawyers now who insist that any agreement signed with the company is not required to be notarized by Dubai Courts and the company is not legally bound to give me any cheques as a guarantee.
The company that I worked for is located in Dubai and is a private organisation.

Following up on a labor case after traveling to the home country 0
After working for my employer for nearly two years on an unlimited contract as a COO of a restaurant company, my employer owes me approx 193000, not including notice period.
I have filed a case with the MOHRE. They have tried to contact the employer who has ignored the calls and is also ignoring me.
I know that I will have to escalate the complaint but, based on experience with the way the employer treats past employees and how he ignores suppliers and landlords, it is fair to assume that he will ignore this as well.
I have little options and I have to leave the country as the apartment rent paid by the company expires mid-July. If I leave, can I maintain the complaint, and what is the likelihood of getting the money owed in this scenario when I travel back to the UK?
