How to enforce an execution file for alimony and maintenance if my ex-husband offers settlement?

Hello. The question is about my execution file in the Court of Personal Status in Dubai.

In 2013, a judgment was made for the father to pay AED 2K monthly for Nafaqa (alimony) and AED 40K annually for house rent. However, the father consistently delayed payments, despite having a monthly income of AED 30K.

I attempted to settle the matter through court procedures in 2015 and 2017, but the father didn't follow through. By 2021, the outstanding amount was AED 145K, leading me to request an arrest warrant.

The father claims he's not working, but I am aware he's involved in a construction business with his brother to avoid court responsibilities. He has no property or financial resources to block.

In 2023, the outstanding amount increased to AED 206K. The father hired a lawyer to remove the arrest warrant, and now they seek a settlement. The court admin insists I attend the settlement meeting.

What do you suggest?

How can I protect the rights of me and my daughter, since I cannot afford a lawyer?

I would advise you to attend the meeting and ask for full payment.

Thank you for your reply, and what shall I do if they claim they cannot pay in full?

Don't agree on anything, if you have any credit cards or loans on you, you can say that you're paying these charges which should also be given to you, and also all the expenses of your daughter for which you can file another case as well.

Ok, thank you.

I have other cases too but nothing works, unfortunately.

Thank you for your advice anyway.

Gather all relevant documents and proofs showing you the father has an income.

Prepare a list of your demands and also do not settle for an amount that is so less but for a fair amount only.

If you are unable to reach a settlement, then you should request the court to enforce the original judgment.

You can reject the settlement and continue the execution procedures, especially the arrest warrant, and follow up with the investigation department and provide them with his address data and phone number for the arrest order, travel ban, seizure of his money at the central bank, cars, licenses, etc..

Dear Client,

Thanks for your question, I hope you are doing well. I will definitely assist you in this matter.

Attend the settlement meeting as directed by the court, document all relevant case details, and explore legal aid options in the UAE, such as the Dubai Foundation for Women and Children or the Dubai Legal Aid Center, to assist you if you cannot afford a lawyer.

During the meeting, negotiate for a fair resolution considering your daughter's interests. If an agreement is not reached, continue enforcing court orders for payment through legal means.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will definitely be happy to help you.

Thanks & Regards
