Q: Dear sir/madam, I filed a case against my employer. I got my judgment but the problem is the company's appeal. So what my employer wants is, that they will pay only the EOSB that I signed with the company and not the judgment amount. Does the employer have the right to pay only the EOSB that I signed even though I waited for almost 5 months and still not paid? Does the employer have the right to pay me in an installment payment? س: السلام عليكم، قضية عمالية جزئية مبلغ المطالبة فيها 70.000 درهم وتم عمل استئناف من جانب العامل. هل عند تسجيل استئناف عمالي يكون هناك مبلغ 1000 درهم تأمين أم لا؟ حيث أن المبلغ المُطالَب به هو 70000 درهم؛ وهو مبلغ أعلى من النصاب الانتهائي للمحكمة.

س: السلام عليكم، تم استئناف قضية وتقرر تعيين خبير مصرفي من طرف المحكمة والخبير أعطى تقريرًا بخطأ البنك وعليه رد المبلغ للمدعي، ولكن المحكمة لم تحكم لصالحي ولم تأخذ بتقرير الخبير المُعيّن من طرف المحكمة نفسها. السؤال كالآتي: 1- ماذا لو كان مبلغ المطالبة 50 ألف درهم بالضبط؟ 2- أيضًا ماذا لو كان مبلغ المطالبة 50 ألف درهم (وكان في دعوى المطالبة بفائدة)؟ 3- هل ستقبل المحكمة بفائدة وتعتبرها أكثر من 50 ألف؟

س: السلام عليكم، هل يجوز الاستئناف على حكم عمالي قيمة المطالبة فيه 30315 درهم وتم الحكم فيه بـ 26310 درهم؟ مع العلم أن المُدَّعَى عليها فتحت استئناف وقُبل الطلب. هل يجوز ذلك أم لا؟

س: السلام عليكم، لدي قضية عمالي جزئي وتم الحكم فيها بمبلغ أكثر من 50 ألف بقليل بالرواتب المتبقية ومستحقات نهاية الخدمة وبدل شهر الإنذار وراتب الإجازة، والمحكمة لم تحكم لي في الفصل التعسفي لعدم وجود نتائج وآثار على المُدعي. دخلت في مهلة الاستئناف وقبل انتهاء المدة بثلاثة أيام، استأنفت الشركة على الحكم الصادر وقدمت مستندات أغلبها تؤكد الحكم، ولكن تم تقديم الاستئناف لتطويل مدة الدعوى. هل أستطيع إعادة المطالبة بالفصل التعسفي 3 أشهر وبدل عن غرامات تأخير الإقامة وتعويض شهرين مدة القضية؟ ولأنني لا أملك المال لتوكيل محامي فقد كتبت مذكرة على مذكرة الاستئناف، ولكن لا أعرف الصيغة القانونية لتفاصيل الوقائع والرد والجواب. شكرًا مسبقًا واعذرني على الإطالة!

س: السلام عليكم، لدي قضية عمالية حُكم فيها بمثابة الحضوري في 13/04/2022، ومن ثَم أعلنت الخصم بموجب طلب قدمته للمحكمة، وبعد الإعلان تم عمل صيغة تنفيذية والإعلان للمرة الثانية بالتنفيذ في 03/08/2022. تقدّم الخصم بتسجيل دعوى استئناف على الحكم الابتدائي بزعم عدم استلام الحكم الابتدائي بالرغم من أن الإعلان كان بنفس طريقة إعلانه بالصيغة التنفيذية. رجاء الإفادة عن مدى قانونية دعوى الاستئناف!
