Can ex-boss demand ticket money back after I returned to the UAE?
Dear Sir/Madam,
I finished my contract and asked my boss to pay for my ticket back home upon visa cancellation. He gave me the money after I confirmed that I was not going to stay in the UAE.
At that time, I was looking for a job in different Gulf countries. A couple of days before leaving the UAE, I was offered a job in Dubai and accepted it. I left and went back a month later and got my new visa after two months.
Now, my former employer wants me to return the money for the ticket. He insists that I have no right to a repatriation ticket because I didn't leave forever and came back.
He threatened to pursue legal action if I refused to return the money. He considers this fraud. Is there anything in the UAE Labor Law Article 131 that obliges the employee to leave forever?
What are the chances that my boss opens a case against me?
Dear Client,
Thanks for your question! I hope you are doing well. I will definitely assist you in this matter.
Article 131 of the UAE Labor Law typically requires an employer to provide an employee with a repatriation ticket upon the termination of their employment contract.
However, your situation is unique because you initially accepted the money for the ticket but then returned to the UAE for a new job.
While there isn't a specific provision stating that the employee must leave forever, your employer may argue that your return to the UAE after accepting the ticket money constitutes a breach of the agreement.
The outcome of any potential legal action would depend on the specific circumstances, agreements, and evidence involved.

Dear Questioner,
There is no such clause and there is no provision for the employer to send the employee forever to his home country.
And regarding the repatriation ticket, it's considered a benefit that the employee received for his service.
