هل يمكنني رفض دفع الإيجار إذا لم يوفر المالك الكهرباء؟
سيدي/سيدتي،
لقد استأجرت مستودعًا من مالك عقار بتاريخ 13 سبتمبر 2022، مقابل إيجار سنوي قدره 50000 درهم إماراتي. دفعت القسط الأول وقيمته 12000 درهم إماراتي. المستودع هو ورشة عملنا حيث نقوم بتصنيع طلبات العملاء.
كان لدى المالك مشكلة مع بلدية أبوظبي، لذلك لم يصدر لنا عقد إيجار حتى 15 فبراير 2023. بعد أن تلقينا عقد الإيجار، اكتشفنا أن المالك لديه أيضًا مشكلة مع شركة أبوظبي للتوزيع.
بسبب هذه المشاكل مع المالك، لم نتمكن من الحصول على توصيل الكهرباء لورشتنا حتى 9 مارس 2023.
يطالب المالك الآن بإيجار لهذه الفترة، لكننا رفضنا الدفع لأنه لم يكن خطأنا. كما تكبدنا الكثير من الخسائر خلال هذه الفترة لأننا لم نتمكن من تلبية طلبات العملاء بسبب نقص الكهرباء.
كان علينا أيضًا دفع رواتب لقوى العمل العاطلة لدينا. رفع المالك الآن دعوى تنفيذ ضدنا باستخدام شيكات التقسيط. ما هي الإجراءات القانونية التي يمكننا اتخاذها ضد المالك الآن؟

The only way for you to challenge this cheque enforcement case is to file a cheque dispute appeal (إشكال).
In this appeal, you would have to present evidence that proves:
1. That the cheque is for rent.
2. That the rent is not justified for the previous period mentioned in your question as your company was not able to make use of the rented warehouse due to the negligence of the landlord.
If both points are proven (by documentary evidence, witnesses, and/or experts), then the cheque can be nullified.

You can sue the landlord for the inconvenience caused to you, but not in terms of nonpayment of rent.
