Q: My brother in law is in jail for taking AED 12 million from his company and he is in jail (Abu Dhabi, UAE) under remand. I don't know whether he had taken the money or not, but his employer is saying he had taken it and given him a confession letter. I don't know about the confession they took. I had not seen him because it happened last week and I am not able to go and meet him as it is very far from my house and also I have no blood relation.  I need to take permit from the prosecution department. I trying to meet him by next week. Kindly advise me what I need to do. Also, advise me on: 1. Suppose the above thing has happened, how many years he needs to be in jail? 2. If it is a false case by the employer, how will we prove his innocence? 3. Will the court give a chance to him to prove he is innocent and how? Please note that he has no advocate. 4. I assume this will be a false case as the employer is saying he started doing so for the last three years. This company had every year annual audit and they did not find.

س: السلام عليكم، أرغب في تقديم شكوى تشهير في دبي (تصريحات تشهيرية كاذبة دون سب وقذف عبر الإعلام بالصوت والصورة). حسب علمي، فالتشهير في دبي يُعتبر جريمة (أي جناية وليس جنحة)، وعند دخولي إلى تطبيق شرطة دبي واختيار "فتح شكوى جنائية" فإن نوع البلاغ بحسب الخيارات المتاحة هي فقط كالتالي؛ ولا تحتوي على التشهير: "خيانة أمانة - السب والقذف - السب والقذف عن طريق الهاتف أو الوسائل الإلكترونية - التهديد - إزعاج بواسطة الهاتف - الاعتداء"، فماذا عليّ أن أفعل في هذه الحالة؟

Q: Hi, Good Evening! I was working with a company, and I have started my own company. Now, we have done a hood cleaning in a hotel and later there was a fire that was not caused by us. The hotel owner did not have any problem and we don't have any case. My old company employer is sending fake news with a photo of our company certificate saying that civil defense has taken our license and contract. Q: A verbal abuse complaint was filed against me. Though there is no witness and no direct evidence, there are a few indirect WhatsApp messages that may be open to interpretation and were provided by the complainant. The police filed a case and seized my phone. It has now been over 3 months. The police transferred to the public prosecutor. However, the case was returned with a recommendation for settlement or moving to a one-day court. The complainant refused to settle before and now does not answer the police calls when they try to get the complainant to sign the notice for one one-day court hearing so this can move forward. I am following up with the police every week but there is no progress. What can be done now? Can I request the police to close the case or move it to one-day court regardless? What are my options?

يعتبر السب والقذف من أبرز الجرائم الواقعة على الأشخاص وأكثرها انتشارًا عبر وسائل التقنيات الحديثة وفي مقدمة باقي الجرائم؛ حيث أنها تعتبر من جرائم الاعتداء على السمعة. وبداية لا بد من تعريف السب والقذف عبر وسائل التواصل الاجتماعي وماهية عقوبته التي شرعها القانون الإماراتي، فهذه الجرائم تؤثر على سمعة الإنسان وخاصة الإناث.

من الضروري البحث عن تطبيقات جديدة وجدية للحد من البلاغات الكيدية بين الأفراد، وبخاصة بلاغات السب عن طريق وسائل التواصل الاجتماعي. للأسف زادت في الآونة الأخيرة بلاغات السب والقذف عن طريق وسائل التواصل الاجتماعي، وظهرت صعوبة في معرفة هل تلك البلاغات حقيقية أم إنها كيدية وسوف يتم التنازل عنها لاحقاً. رأينا أنه لا بد من وضع مقترحات في سبيل الحد في تلك البلاغات.

أوضح القانون الإماراتي أنواع التعويض عن الضرر والشروط الخاصة به، والتي من خلالها تناول حماية حقوق الأشخاص التي تم التعدي عليها أو على ممتلكاتها من قِبل الغير، وتسبب هذا الأمر في ضرر لها أو لممتلكاتها. ففي تلك الحالة يحق للمتضرر تقديم دعوى للحصول عىل تعويض عن الضرر الذي حدث له من قِبل شخص آخر. وقد ميَّ قانونين المعاملات المدنية الإماراتي بين نوعين من الضرر، مادي وأدبي أو معنوي.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this Federal Decree-Law No. (31) of 2021 Promulgating the Crimes and Penalties Law, known as the "New UAE Penal Code", governs criminal actions in the United Arab Emirates. The New Penal Code repeals the previous UAE Penal Code (Federal Law No. (3) of 1987 Promulgating the Penal Code).
