Our tenant is trying to delay eviction for sale and her cheques have bounced. How to evict her?

Hi,

We have an apartment that we are trying to sell and we also have a tenant living there. Her contract is until the end of May 2023.

We sent her an eviction notice through notary public on Dec 2022 and she has 1 year to vacate the apartment. She wants to extend her contract from May to Dec as she is still allowed to stay til December as per notary notice.

However, we are trying to stop her extension as she has bounced cheques, and she has been very uncooperative with agents viewing the apartment which is delaying the process of selling the apartment.

What can I do with this?

You need to go to the Rental Dispute Committee and advise them that she has been obstructing the sale of the property.

And although she can renew till Dec, she has not paid and she got bounced cheques which is a reason for the eviction.

You have to file a case to vacate her in RDC immediately and file another case in court with the cheques.

Send her a notice to pay the rent that is due, and if a month has passed since she has not paid, you can file a case against her to vacate the apartment.
