Q: I was recently terminated from work. My employment contract with the company, signed in March 2012, states clearly: on the resignation date of your employment, the employee shall remain under the work and residency visa of the company for a period of 3 months effective from the date of resignation or termination.
However, the company informed me that the recent changes to the law in the UAE since my contract was signed states that cancellation of employment visa and residency should be done within one month and that those changes supersede the wording in my contract.
Is this true? Or the wording in my contract is still valid?
Please advise.

Q: Q. Visa Cancelled, the grace period is about to finish while there is a pending case in the court against my employer.
Good evening.
I have cancelled my visa, and the grace period is about to end in a week, while I have a pending case in the court against my employer.
Can I get permission for overstay to avoid the fine and blacklisting?
Can I engage the services of a law firm if I cannot do it by myself?
Politely requesting to assist me, please. I am in a big trouble.

Q: Hello Mr Naser,
I am on an unlimited term contract that started on April 8th and I have been terminated with a 3-month notice period that ends on December 11th. According to my line manager, my probationary period was already completed.
Having not found a new job as yet, I asked the company HR if I could keep the visas for just another month and they flatly declined, stating that according to their policies they cannot.
I have given few interviews and been waiting for responses. Since this is the Christmas season where all expatriates mostly leave to their homelands, getting a response during this time is very slim and hence I had asked for the 1-month extension.
My family consists of my wife, I and 2 kids who are going to school. Doesn't the UAE labour law stipulate any regulations for the person that is terminated and have school going kids who are just in their 1st term of the academic year?
Please advise if there is anything I can do legally or not.

The grace period granted to employees after visa cancellation

Q: I have been given a 5 day grace period post my visa cancellation.
It was cancelled on the 8th of January and the document says I need to exit by the 13th of January.
Shouldn't I be given 30 days for exit or change?
What should I do?

How to extend the duration of visa upon termination while the employer refuses?

Q: I have been terminated from an unlimited contract in a company at ADGM. The company is paying me 3 months' notice pay as per my contract and not giving me the option to work during the notice period.
They want to cancel my employment and residence visa on the termination date and not the last date of the notice period, as my last working day will be the termination date.
I need my visa to be kept open till at least the notice period end date but not sure what is the law on this.

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
