Q: I was terminated from my company on the accusation of theft. My company said that they have a CCTV footage which they did not present during the committee meeting. There was no money or goods retrieved from me by my company security. They only have my admission.
Since they were telling me that they will send it to the police if I won't admit that happened on 19 March, the committee meeting which was supposed to investigate was held 2 days after.
My company kept me suspended until the 5th of April and handed me the termination letter, which states that I am terminated from the 19th of March.
What are my chances on this? I am so confused right now and I really need help.

Deferring the hearing of a labour case till deciding on a criminal case

2
Q: Suppose the employer finds out that the employee has been contacting his clients, and selling vendor products to such clients and accepting money. This has been captured in a CCTV footage, submitted to the police and the case is being under investigation.
Now, the employee does not report to work and files a case in the MOL for overtime and not salary, as the salary is paid on time and payslips are signed by the employee.
Since based on the final judgement, all the benefits for the employee may be nullified as per article 4 of the preamble, can the employer request the MOL to defer the hearing in the case till a final judgement is received in the police case?
Pleases advise if any other means can be taken.

Accusation of theft and termination under Article 120

Q: The possible way to cancel my visa.
Hi Sir/Ma'am,
I was terminated from my company on the accusation of theft. My company said that they have a CCTV footage which they did not present during the committee meeting on 03 Jan.
There was no money or goods retrieved from me by my company security. They only have my reports. The committee meeting which was supposed to investigate was held 2 weeks after.
On Feb. 03, I received a complaint from MOHRE, so I went there with the PRO to settle things. I signed a paper without informing me what's written in it and no translator was provided.
They talked Arabic language only. I checked with labour the status of a complaint but it was closed.
My company kept me suspended until the 10th of March and handed me the termination letter, which states that I am terminated from the 03rd of Jan.
What are my chances on this? I am so confused right now and I really need help. It's been 4 months until now I'm still waiting for their decision.

Protection from an accusation of theft by the employer

10
Q: I am the manager of a boutique retail store in Abu Dhabi.
My company has not been earning money, details I am privy to due to the report I send to the owners, my boss.
I know they considered filing bankruptcy last year when his loan application was denied. Now, my boss is suddenly accusing me of theft a week before my vacation.
He says items are missing in the inventory. When I joined 2 years ago the inventory wasn't complete, and when we changed the systems this year, items were not migrated properly.
I suspect this is their way of regaining back loss, accusing me of theft.
How do I protect myself?

Filing a compensation case against an employer for accusing an employee of theft
4
Q: Hello,
I was having a criminal case going on in Dubai court for the last 10 months and the case was filed by my employer regarding data theft but now the judgement has come up in my favour.
I would request you to help me regarding whether I can file a compensation case against my employer.
I was working in this organization for the last 3.5 years and resigned in Jan 2019, but they stopped employing me in the middle of the notice period. They told me that they will cancel my visa and clear outstanding dues. But it didn't happen and then I filled a labour case and won.
But in March 2019 they filed a criminal case and the judgement has come in this month as innocent from the first instance court. I was jobless for the last 1.5 years and I'm totally defamed in the market and can't get a new job.
Please advise whether I can file a civil compensation claim to cover my liability and wastage of money due to this case.

Accusing an employee of stealing and firing him while being on vacation
2
Q: Hi,
I've worked 8 years and my company fired me a month ago while I'm on vacation for accusing me of stealing 10K (AED). They have evidence and show my signature that I signed last 2019; it happened 2 years ago.
I asked them to show me a CCTV that I took the money but since it happened 2 years ago, my company cannot provide CCTV footage or eyewitness.
Now they file a case against me in Dubai and I have provided all evidence to the police station where they opened the case. I am still waiting for the results of the prosecutor's decision.
1. What are the chances of winning this case?
2. If I win (inshAllah), can I sue them for wrongfully accusing me?
3. Can I still get my end of service for 8 years and my last month's salary if ever I win or lose?

What can the employee do against accusation of theft and termination?
5
Q: Hi
My company terminated me in April due to theft. I was told a criminal case has been filed against me. Since then I have not received any call from the police.
Now the company has still not cancelled my visa since then and I don’t know what to do. I am afraid they may have filed an absconding case against me.
I have a job offer from another company, please advise me on what to do.

The Accused is Innocent Until Proven Guilty 2
In a criminal proceeding, the standard of proof to uphold a conviction is beyond a reasonable doubt. The prosecution has the duty of establishing the defendant's guilt beyond a reasonable doubt in a criminal proceeding. This implies that the prosecution has to persuade the court that the evidence used in the trial cannot lead to any other plausible conclusion.

View allCan the tenant exit the lease contract early after losing access to gas? 0
There was a gas pipe explosion in our building and the whole floor is unhabitable.
So we are located on another floor, gas usage was cut and had to rely on electric plates which takes longer time to cook and there is the fear of fire if left unattended.
Gas will be reinstalled after 3 months and we wish to terminate the contract early because we cannot use the gas which is one of the facilities we agreed for in the contract and we feel unsafe in the building because every now and then the alarm goes on.
They gave us an option to move to their other buildings but will even be farther from work plus the transportation costs will increase.
Do we have to pay penalty charges for a situation that is not our doing? We are already having heart palpitations whenever there’s an alarm?

Is it possible to terminate an employee due to her bad attitude 0
Good morning,
We have given an employee a final warning due to attitude and creating fights with employees.
Last time, she did the same thing after that she left the office early without informing the manager (she informed the owner of the company which is not the direct report) after that she was absent for 2 days without informing the same.
She sent a message to the owner of the company, but the owner did not reply nor approve her reason for being absent.
Is it valid that I serve her termination?
Thank you!

Filing a case for higher maintenance and possibility of travel ban 0
I'm an Australian non-Muslim expat resident for 10 years. My wife is the same, as are our three children, ages 19,16 (girls) and 11 (boy).
I have opened a case for divorce in Australia, and the hearing is in November. My wife wants to take me to court in the UAE regarding child maintenance.
I currently pay 35% of my monthly salary to my wife for child support. She wants more. I am due to leave the country next July permanently.
If she opens a court case, will that stop me from leaving? Has she got a case for more money?

Removing a travel ban requested by the guardian of a child 0
My question is about my son who has a travel ban for the past four years.
I am a divorced woman and the travel ban is from his father. I want to move back to my home country as I don't have any emotional or physical support here.
My parents are old and would like to move back for good. I have tried discussing this matter with his father but unfortunately, the matter is still unresolved.
I am willing to let go of all financial support in order to go back. Please let me know if this can be resolved in any way.
