Failing to return to office after vacation and its consequences

This is Durga Devi from India.

I am working in a concern in Dubai. I came for vacation on May 18, but due to my two-year-old daughter health issue, I was unable to return to office Until Sep.

I informed my office and mailed the resignation letter on Sep 5. Now, what is the procedure to cancel my employment visa since I am unable to rejoin?

FAILURE TO RESUME DUTY AFTER VACATION: The employer may terminate the services of an employee who fails to resume his duties at the end of such leave.

LABOUR BAN

If you have a visa and if you did not complete one year of service, an automatic SIX months or ONE-YEAR labour ban may be imposed by the Ministry of Labour upon a request by your employer.

No employment visa shall be issued to you until the period of the ban is completed.

The basis of application:

Limited contract: failure to complete the term OR provide/complete the notice period - 1-year ban.

Unlimited contract: failure to provide or complete the notice period or terminating the contract/resigning from the job before one year the contract - 6 months to one year.

Therefore in all likelihood, you have been declared as absconding and this would involve permanent ban.

Permanent Ban: applicable for serious offences such as illegal/criminal activity or absconding.

With the eye scan and fingerprint taken by the authorities, it is impossible to re-enter the UAE if one has a permanent ban whether as a visitor or for residency.
