What can I do if the landlord sent me a rent increase notice above the allowed limit?
My landlord has given me a 20% increase notice 90+ days in advance. As per Dubai REST app, the permissible increase is 10%.
I have reverted saying it is not as per decree 43 article 1 and 3 but there has been no response.
Also, as per the earlier contract, there are some maintenance activities that the landlord should do but that are still pending.
1. Would the notice be null and void as the increase is beyond the permissible limit? And can I request the same rent as last year?
2. What should I respond to the notice as it is already 20 days since I received the notice?
3. What are my options?
4. How do I get the maintenance done?
5. Should I wait till the end of the current contract and negotiate after that or the landlord can get me evicted?
A complaint can be submitted regarding the pending maintenance to the owner.
Also, an objection can also be submitted to the increase and it must be in accordance with the permitted increase, or a complaint may be submitted for renewal in accordance with the law.
The landlord has no right to increase the rent 20% because this against the law.
You have to send a legal reply to the landlord about his notice because not sending a reply means you accept what the landlord sent.
If the landlord does not do the maintenance, you do it and we then collect from him.
