How can a wife claim her rights from ex-husband after divorce and leaving the UAE?

Assalamu Alaikum

I am a Pakistani woman currently living in Pakistan. I am stuck in a case where I am already divorced by a man, who is currently living in Dubai, 7 months ago after 4 years of marriage.

I also lived in Dubai after marriage for a few months on & off. The main issue now is his family in Pakistan & him in Dubai are not giving me back my dowry, my Haq Mehar & maintenance amount (which a woman can claim for not giving her a penny as a monthly allowance for years during marriage).

They are demanding to return 3 gold sets to them first which they have given me as a gift at the time of the wedding & engagement. I am not obliged to do so as they are mine now according to the shariah law.

I would have given them back if they were good poor people. I don't feel like fulfilling their illegal demand as they have ruined my life.

If I file a case in Pakistan to claim my things back, can the UAE's law help me out too to pressurize him to do the right thing?

Thank you

Wa Aleikum Alsalam,

We advise you to proceed with the claim in the UAE, it will be more enforceable than there.

You are welcome to file a lawsuit to recover all dues arising from the marriage contract, including alimony, pleasure "Mutaa", Idaa, housing, bedding, and other marital rights due from the marriage contract.

In this case, it is in your interest to litigate in the UAE because the husband is in Dubai, especially since the law of the Emirates is in the interest of the wife, and it is compatible with Islamic law, and gold is the right of the wife, as he enters into the mahr (dowry).

But to file a case in the UAE, I have to pay a huge amount for a lawyer. Right?

Or is there any policy for foreigners who don't have jobs or much money to afford lawyers in the UAE which can give them some financial benefit?

Lawyers get a down payment and the rest after collection.

Can you please kindly tell me how much in total is it gonna cost me approximately?

And do I have to be in the UAE for this procedure?

It is not a condition that you are in the UAE. We will let you know the costs.
