Although I trust him and I know he was really in need, he issued blank-dated cheque signed by him and gave it to me as a security to repay me as promised by September last year. It's been 6 months now, and I am calling this person to repay the money but he is not interested to pay me and not answering my calls and messages. I know it is a small amount but for me who has a family back in my country, I really need the money for my obligations also. Please advise me what actions I must take to recover my money. he told me before not to encash the cheque because he already closed the account, but then he is not returning my calls anymore. How can I recover my money? Can I file a police complaint against him?

Q: I have a bounced cheque issued by a person who has already left the country and closed his local bank account. I filed a criminal case with the police some time ago, but there is no result till now. Can I do something else to get the money?

Q: Hi, We are planning to buy a beauty salon and we have given the owner a deposit of AED 20k. After a week he asked for another AED 50k as he has dues that need to be settled with the landlord. He gave us a cheque for AED 50k which bounced because the account has been closed a long time back as per the bank. It’s been 49 days and the transfer is not done yet. Can we file a civil case and ask for moral damage as we lost a lot of money since the business is not operating yet? Can we still get our AED 70k that we had given to him?

Q: Hi, When signing the tenancy agreements, is it wise to give post-dated cheques for the quarterly payments in advance? Because from what I gather, when you issue a cheque you are bound to honour it although the contract is not fulfilled at a later part. Please advise. Thank you.

Q: Hello, This is regarding a post-dated cheque given by my earlier landlord for the return of the deposit. I had cleared the apartment in May 2019 and he gave a cheque for March 2020. Now he is saying that the account is closed and he will give cash but is still delaying. Can I deposit cheque and if it bounces, can I file a police complaint. What do you advise? This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this Decree by Law amend the Federal Law No. (18) of 1993 by replacing Clause (4) of Article (379) as well as Articles (600), (617), (641), (642), (643), (644), and adding new articles numbered (635) Bis, (641) Bis (1), (641) Bis (2), (641) Bis (3), (641) Bis (4), (643) Bis (1), (643) Bis (2), (644) Bis (1) and (644) Bis (2). The Decree-Law also repeals Articles (401), (402) and (403) of the Federal Law No. (3) of 1987.
