Q: Dears,
I have a health insurance claim of 50K AED that was rejected by the insurance company because they think it is a pre-existing condition. The health issue was a heart attack that occurred for the first time so it is not a pre-existing condition.
I would like to make an appeal on that rejection. I have all the documents (medical reports, invoices...).

Insurance claim of no liability to cover suicide cases

Q: A person expired and the cause of death is suicide.
Insurers in the UAE have rejected the claim on the grounds of the suicide exclusion which is applicable by law:
"This insurance does not cover death as consequences of:
c) Directly or Indirectly occasioned through any unlawful or criminal act of the insured person."
Is suicide considered unlawful or criminal act in the UAE?

Insurance policy cancellation for defaulting on contributions

Q: I took insurance policies with a reputable company. There is initial contribution period of 2 years, wherein you cannot withdraw or touch your own money.
Both policies started around April 2014 and I paid diligently until October 2015. The monthly contribution is around AED 2100 per month. I stopped the other plan briefly then continued to pay until around April 2016.
Because of more financial difficulties, I was not able to pay my monthly contribution starting April 2016. My financial adviser said that my money is still there until maturity.
When I checked again, my policy is gone along with my contribution. The call centre agent said it went to the charges.
I have another plan, which is also untouchable at the moment. The financial adviser did not tell me anything about it.
I want to complain about the insurance company, as well as the broker where my financial adviser works.
Is there any legal way to recover that money? I hope you can help me.

Claiming compensation for a labour accident from the company insurance

Q: I am seeking advice on behalf of my sister.
My sister's husband worked for a company in Dubai and was away on business in Singapore, on a free weekend he took a leisure trip to a Malaysian island and was, unfortunately, killed in an accident.
The company said that the business insurance will not cover the accident due to it being a leisure trip whilst on business.
They are also withholding access to his laptop, although it is a work laptop, she feels there might be important policies, accounts and documents on it that are online only with no paper documentation.
She will need to visit the UAE to sort out his flat and belongings, close any accounts he may have had and visit his employer to recover any payments due and discuss insurance payments.
She has asked me to see if I can find any legal advice relating to these matters and to ask if there are points to be wary of, and, once she is back in the UAE I guess she will need legal representation in these matters.

I am planning to buy a property in Dubai.
I would like to add my wife and brother as co-owners for the property. My wife and brother are employed and I am self-employed for the past four years.
I would like to know what are my options for applying for a Home Mortgage in this scenario.
Can we apply together for a mortgage from the bank or would it be ideal for two salaried people which is my wife and brother to apply for a mortgage?

Offering a loan with a condition to pay 1% insurance in advance

Q: Hi,
I am based in Kuwait and an Abu Dhabi-based finance company is offering me a loan of 100,000 $ with a condition to pay 1% insurance in advance to process the loan.
Their office is located in Abu Dhabi. I want someone to verify this company's credibility; to know whether they are genuine or fake, check their license/registration, etc, and understand the conditions of the loan, furthermore, pay that 1% insurance fee only if they are satisfied.

The provisions of this Law apply to the mortgage of real roperty as security for debt. It makes no difference whether the debt is secured by a charge over the whole of the property or over an undivided interest therein or by right in rem or personal right over a property marked as sold off-plan.

I have two questions:

(b) The second question is, do I have to renew the rental agreement for 3 months (until December 2024) or not?

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
