Questions & Answers
What are the conditions where the public prosecution allows recording a conversation?
If you believe a crime or fraud is taking place against you and you are speaking with the group you believe may be committing the fraud against you, can you record that conversation?
Calls may be recorded (without prior permission) if they contain insults and slander, and this is the only case in which recording is permissible, and only the partial judge has the right to issue prior permission to record calls in accordance with Articles 95 and 206 of the Code of Legal Procedure, and surveillance is ordered.
Dear Questioner,
According to UAE law, it is against the law to record a conversation without the consent of the other party.
However, only in some instances may the court accept such evidence in court and that depends on the content of the voice recording.
Otherwise, the court will dismiss the evidence and the other party may take legal action.
You may take permission from the public prosecution or the police to record the conversation beforehand.
