Is it legal if my property agent was recording our conversation while talking on the phone?
Dear Legal Advice Team,
I would like to ask if it is legal to record a Voice Call in the UAE.
I was talking to my property agent, and right in the middle of the call, She mentioned that I am recording your call, which was shocking as she did this without my consent.
Can you please advise what do the current CyberCrime and Privacy laws in the UAE state on this?
It is not illegal to record you without your permission if it contains insults and slander, and this is the only case in which it is permissible to record.
And that only the partial judge has the right to issue prior permission to record calls in accordance with Articles 95 and 206 of the Code of Legal Procedure, and surveillance is ordered.
Article (431/1) of Federal Decree Law No. (31) of 2021 on Crimes and Penalties stipulates that "anyone who violates the sanctity of the private or family life of individuals in cases other than those authorized by law or without the consent of the victim by listening or recording or transmitting through a device of any kind conversations that took place in a private place or by telephone or any other device shall be punished by imprisonment and a fine."

According to the UAE Cybercrime Law, telecommunications, and the penal code, it is illegal to record a conversation, phone call, and so on without the consent of both parties.
Regardless of who the parties are, it needs to be stated that the phone call will be recorded and the consent of the other party has to be given.
