هل يجوز زواج شاب عمره 19 عامًا وفتاة عمرها 16 عامًا من الوافدين في الإمارات؟

أنا شاب أبلغ من العمر 19 عامًا والفتاة التي أريد الزواج منها تبلغ من العمر 16 عامًا. لا يوافق والداها على زواجنا.

لذا أرجو إخباري بطريقة ممكنة للزواج في الإمارات بدون ولي، حيث أننا وافدين (من باكستان).

Dear User,

According to UAE law, any person who marries, or wishes to marry, in the UAE and is below the age of eighteen would be considered null and void.

In other words, this would mean that the marriage is non-existent from the beginning. This is in accordance with Sharia law and the UAE personal status law which applies to both UAE nationals and non-nationals.

Furthermore, parental consent will still be required when both or either of the applicants for marriage are between eighteen to twenty-one years old.

There are some exceptions to getting married in the UAE when a party has not reached puberty and one exception is if there has been judicial consent given, i.e., the Court found that puberty has been reached prior to reaching the minimum age requirement (18).

It should also be noted that Sharia marriage and civil marriage (non-Muslims) are different in regard to the legal requirements.

In a sharia marriage, the bride's father needs to be present along with two male witnesses, and the woman's guardian needs to give his consent, regardless of age.

It is advisable to seek out legal counsel regarding the situation.

Unfortunately, there must be no consent because of the girl's rule and reaching the legal age.
