Termination of an employee with a false accusation of supporting another company

Dear sir/madam,

I was working for a private company for more than 10 years and I didn't receive any warning letter but I received a termination letter on 14th Nov 2022 after I completed the annual vacation (approved leave from Nov 3 to 13th Nov 2022).

The termination letter didn't mention any resignation. It just mentioned that: "your employment has been terminated immediately".

After that, I visited our office to discuss it but HR said: "you support another company that's why we terminated you", but I informed him that I didn't support any company and asked him to show me the proof but he ignored to discuss with me.

After 10 days, there was no response from the company so I filed a complaint to MOHRE to get my leave salary and end of service.

Now the case is forwarded to the court and the first trial date is 15th, Nov.

Please advise!

May the company refuse to pay?

Hello to you,

This is an arbitrary dismissal.

You deserve 3 months' salary as compensation and any dues to you, and also the company cannot accuse you of any accusations without evidence, otherwise you will be subjected to compensation paid to you.

Is it possible for the company to highlight termination based on Article 120?

The termination letter didn't mention any reason for termination of employment.

Article 120:

The employer may terminate the employee's contract without being bound by the notice period, and deprive the employee of end-of-service benefits in the following cases: If the worker impersonates a false identity or nationality, or submits false certificates or documents.

File a lawsuit for compensation for arbitrary dismissal and recover your dues.

The worker can submit a complaint to the Ministry of Labor over the phone or the website.

All entitlements must be accounted for (overdue salaries, vacations, end-of-service benefits, airline tickets for him and his family, compensation for unfair dismissal, and any other entitlements according to the contract).

The matter is presented for settlement before the employee of the ministry, and if the solution is not resolved, the file is referred to the court, and a session is set for its consideration before the judge.

After the ruling, an implementation file is opened to collect the amount.

There are many actions that can be taken against the company to enforce the judgment.

Seizure of bank accounts and company cars, banning the manager from traveling and other procedures.
