Questions & Answers
هل يمكن للشركة إنهاء خدمتي إذا رفضت العمل لمدة 12 ساعة؟
Dear User,
It is unclear whether you are a part-time or full-time employee, earn a daily wage, or work in the public or private sector, so we shall give you some general guidelines regarding the UAE law and overtime.
According to the UAE Labor Law, the normal working hours for those within the private sector, with some exceptions, are 8 hours per day or 48 hours per week.
However, the working hours may increase or decrease for some categories of workers.
Further, an employer may ask an employee to work overtime (provided it does not exceed 2 hours) and shall compensate.
In general, 12 hours is exceeding the allowed working hours (8) + overtime (2) and hence it can be against UAE Labor Law.
However, there are also exceptions where overtime may exceed 2 hours and that is where the "work is necessary to prevent substantial loss or serious accident or to eliminate or alleviate its effects."
In some cases, an employer may have included a clause regarding working hours and overtime in the employment contract so please refer to your contract.
If employer terminates you for refusing to work 12 hours a day, provided it is against UAE law and the employment contract, then you may lodge a complaint with MOHRE.
Kind regards,
