Possibility of extradition from the UAE for a bounced cheque

Dear Mr Naser,

I am a dual UK - Iranian national and have a criminal judgment against me in Iran due to a bounced cheque. I have been sentenced to 1 year in prison.

I am currently in the UAE, what is the probability of extradition to Iran to serve the sentence?

Given that there is indeed an extradition treaty between the UAE and Iran, all things are possible for an extradition request to be made against your residency here.

However, it would depend on the amount of the cheque involved and whether or not the aggrieved party will move Interpol to have you extradited.

Extradition is only possible when Interpol is brought into the picture so it fully depends on that aspect.

Thank you for your response.

But having entered the UAE on my British passport and as a British citizen, would my dual nationality not have any bearing on possible extradition?

Also, the cheque was issued around 4.5 years ago.

Given that you are a UK passport holder and that Iran does not have an extradition arrangement with the UK, the chances of your being extradited become that much more complicated for the aggrieved party.

Were there indeed to be an extradition request you could very well challenge it through court procedures in the UAE.
