How to cancel your visa and avoid labour ban if the company owner has absconded

A Filipino expat has a company visa with designation "Office Clerk" with a salary of 2,500AED which is expiring in August.

The company owner has run away from the UAE so the court will have to cancel this visa. Apparently, there will be an automatic labour ban for 1 year.

I want to hire the person in my own company in Dubai. Is there any way to lift this labour ban?

Dear Sir,

Pursuant to your query, we would like to suggest you that in such a case the employee has to herself lodge a complaint with the MOL for cancelling her employment contract with the previous employer, explaining everything in detail.

If the Labour Department accepts her request then she will not be subject to a ban.

Dear Janice,

The employee has to herself file an application of complaint with Tasheel (as Tasheel is directly linked to the Ministry of Labour) mentioning the fact that the employer has absconded.

Please note that this complaint has to be lodged within 3 months from the date this subject matter came to the knowledge of the employee.

If this condition is satisfied along with the subsequent investigation by the Ministry, the employee's visa will be cancelled without facing any ban.
