The company gave me a better offer and position and told me to join fast. When I got an offer letter I resigned from the last employer and exit from the UAE for getting a visa from the new company. But the company sent me one visit visa and told me that when I arrive in the UAE they will immediately change it to the employment visa. When I joined here they told me they will change it as early as possible. Last two months I had to work believing their words. Now I came to know it was totally a trap and they have no labour quota because of 4-month pending salaries to staff. When I realized they are cheaters, I resigned and told them I cannot work illegally here. Also, they didn’t pay me the salary for two months. All the staff here are working with expired visa and same like me. Now I want my salary. Is there any legal way to move???

Q: If I have signed an offer letter with an organization and I didn't send all the required documents. Now I want to cancel with this organization. Can I cancel or will I be legally sued?

Q: Aslamulaikum, I have a query, I am on my husband's sponsorship and was working in Dubai with one company. I joined in May 2016. Employer made me sign the employment contract in May itself but did not make the labour card. So I worked with only that contract until finally after chasing the employer made the labor card in October 2016. I worked that 4 months without the work permit. Now as they terminated my employment in March and did not give any right to me I have filed a case in the court against them. I want to know is it legal if I submit my May Contract in the court as my starting date of work. Will it cause trouble for me? Because I want to fight the injustice that happened to me. Please help. Q: I have resigned from “A” after receipt of a job offer from “B”. Then, I kept my family visa on hold and asked "A" to cancel my visa almost 1 week before my last working day. I submitted my visa cancellation paper along with a singed MOI contract to “B”. Now "B" is not responding well and asks me to stay with “A” because of the present COVID 19 lockdown situation. After wasting lots of time, B confirmed that they have applied for a work permit, however, I haven’t received any official confirmation from B's HR. I have checked online on MOHRE website and it shows pre-approval for a work permit. If "B" will not be responding, should I need to worry about my job and visa status? In case "B" will not be responding, do I need to leave the UAE before my visa expiry date. i.e 30 days after visa cancellation? If I stay in the country and join "B" someday, who must pay the overstay fine; B or I? If "B" did not recruit me, then do I have the right to take legal action and ask for compensation towards damage?

Q: Hi, My friend got a job in a restaurant here as a clerk, and the employer gave her a job offer letter and even she did her medical and Emirates ID, there is no stamping from his side. The employer keeps on saying that his trade license is under process. Does it take 3 months to process? It's more than 3 months that my friend went for issuing medical and Emirates ID. She is not getting a salary as she has not been told to join as of now. What steps can she take?

Q: Hello, My child has been refused admission to a French school in Dubai, two years in a row, in Pre-KG (first-class) where all nationalities can apply, because he is a Saudi citizen and the school gives priority to French and Emirates citizens. The director clearly says it is based on nationality because this year we were amongst the first ones to apply. The UAE government does not differentiate between UAE citizens and GCC citizens (Saudis) giving them free education in public schools to be non-discriminatory between locals and GCC citizens. KHDA regulating private schools can speak to the school but cannot enforce the admission because it is the school's internal policy. How is it possible to be bluntly discriminated against two years in a row? Can we legally sue the school for being discriminatory and also can an internal policy be contradictory to government laws/constitutional laws etc? Thank you!

I need to know at what point in the process I should resign from my current company in India. Should I resign after receiving the offer letter, after signing the contract, or after procuring the work permit? Please advise!

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The UAE government introduced the new Unemployment Insurance Law under the Federal Decree-Law No. 13 of 2022 Concerning the Unemployment Insurance Scheme for Unemployed People. The law aims at providing a sort of financial support in case of unemployment for a brief period, probably to help employees who got terminated find another job and avoid failing in other financial obligations.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

According to this Decree, tentative approval to admit a foreign worker for the purpose of employment in the UAE cannot be granted until an Employment Offer that conforms with the Standard Employment Contract is duly signed by the employee and presented to the Ministry of Labour.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
