The landlord refuses to fix any major issues in the property. What to do?

Dear sir/madam,

I am terminating my tenancy contract with my landlord. He gave me an eviction notice in May and since then he has refused to fix any major issues in the property saying that "I'm free to fix it at my own expense", forcing me out of the property.

Given these conditions, am I on the obligation to pay the 2 months' penalty for early termination?

It seems to me that he waited until the contract was renewed to give me an eviction and force me out.

Dear questioner,

Pursuant to your query, as per the law, the landlord needs to give you 12 months' advance written notice which means he needs to serve you the eviction notice at the time of the renewal of the contract.

Moreover, serving the eviction notice doesn't relieve him from performing his obligations which are fixing the major issues on the property. If he is refraining to do so, you have full right to complain to RDC.

Moreover, if you are terminating the contract before its expiry date, you need to pay the penalty as per the tenancy contract.

So, it is advisable to send a notice to your landlord to fix the major issues, and even after receiving the notice he refuses to do so, you can raise it to RDC instead of early termination of the tenancy contract.

The landlord consistently ignores my calls and messages, would it be possible to file a first instance case and ask for the penalty to be waived?

He has been forcing me out since we renewed the contract.

You can still go and complain about it to RDC and don't terminate the contract without making the complaint as you will have to be abiding by the terms of the tenancy contract.
