Q: I want to vacate my flat when the contract expired.
I have a flat in Dubai, I rented the flat last year in August through estate Agent, as I am not living in UAE but in the UK. I am not familiar with the real estate Law in UAE if I intend to give notification to the tenant to vacate the Flat in August when the contract expired.
But Tenant informed me that they will not leave, and they have the right to stay 2 years! And they've gone deal with RERA regulations! The tenant was giving several times wrong cheque...
Have really the tenant such right and what about the Landlord? Thanks.

What is the required notice period for the landlord to evict the tenant?

Q: I recently purchased a property in Springs which is rented till September. I need legal advice on the procedure to send an eviction notice to my tenant as I need to occupy the property for personal use.
As far as I read in the RERA legislation Page 108-110, Article (25) - Section - 2, if the landlord wants to occupy the property for personal use, 90 days notice is sufficient.
But the tenant insists to have a 12-month notice. What are my options and is it possible to send a legal notice to the tenant to vacate the premises at the end of the rent contract?

Just want to know the law incase I want to sell it and the buyer wants it vacant, what will be the notice to the tenant?And if I want to renew the tenancy contract what will be the maximum notice period shall I put for the tenant to give me before they leave?

The arising rental disputes are referred to Rental Disputes Settlement Centre (“RDSC”) created by Decree No. 26 of 2013 to reconcile between the parties and reach an amicable settlement or seek a final judgment issued and enforced by the RDSC.

Respected Advisors,
I have been involved in a few criminal cases since 2017, but all of them were cleared by this year. I have obtained release letters for all the cases from the public prosecution office through an online portal.
Recently, I also received my residence visa. After the visa process was completed, I applied for a PCC online. However, the request was rejected.
I contacted the 901 office, and they advised me to visit the CID. I arranged for a power of attorney to be granted along with all the necessary documents to update the system.
Twice I was told to come in person, but I am hesitant to do so because of my previous negative experience.
Could someone please advise me whether I must go in person or if the person holding the power of attorney can handle the process?

How can the heirs of a deceased person distribute his shares if there is a minor? 1
My father died recently. We are Muslim residents in Dubai. I have siblings including a minor who is 16 years old. My father has land and vehicles under his name.
If I am applying for inheritance, does the minor need to have a share in ALL the properties and vehicles or can she be given a particular property/vehicle?
Secondly, if we want the land to be in her name, and she manages it (like renting and bank), does it require an adult?
Can the vehicles be transferred to someone else’s name without including her?

What are my options if my husband is refusing to pay child support? 1
Dear Sir/Madam,
What are the charges to open an execution file in Sharjah for a divorce case and how much time will it take to execute the court order?
My husband told the court that he does not have money to pay for me and my daughter's expenses because he is earning a minimum amount in which he can only survive.
In that case, what can I do?
He closed all his bank accounts and sent money to his parents in India. He also told me that he will show in court that he does not have a job or money, so the court or police cannot do anything to him.
Can you please guide me on what I can do in this case? I do not have any proof of his salary or bank account because he was not informing me about anything related to his financial matters.
In fact, he was forcing me to ask my parents to send money to us. Because of no proof, the court agreed with him and rejected my appeal. I do not have a job and I am struggling for basic expenses.
Can I request the court to inquire about his gratuity and end of service?
Or can the court ask him to submit proof of the money that he received from his company, as he was working for 30 years in the same company?

When does a travel ban come into effect once the bank files an execution case?
I am the owner of a small company and have had a business loan since 2018. However, due to difficult circumstances, I have been unable to pay the installments since July 2022.
The bank has informed me that they have filed an execution case against me and placed a travel ban on 27.12.2022. On the Dubai Courts website, the case status is currently listed as "Reserved."
I have checked the Dubai Police website and do not see any indication of a travel ban. I am in communication with the bank and requesting their assistance in resolving the situation, as I intend to repay the loan but I need some grace from their end.
In the meantime, I would like to know if the travel ban is in effect upon filing an execution case by the bank and if I am able to renew my visa and my family's visas in this situation.
Your guidance would be greatly appreciated, as I am in a state of distress and have my wife and children here.

How to know if you have a case or travel ban for an old bank debt and when does it drop? 2
Hi Alona,
I had some loans from banks in 2015 which amounted to 400k from 3 banks. Now with the 2022 rule, I checked and there is no criminal case or travel ban against me which is a relief.
I plan to re-enter Dubai but I fear that the banks put again another case against me for these old debts based on the new commercial/civil law. Is the debt finished?
I don't want to get stuck in Dubai for old loans. Kindly advise on my possible course of action going forward.

Can the bank file a civil case after I paid the fine in bounced cheque criminal case? 3
Hi Lawyer,
I had a criminal financial case for a cheque return from a bank credit card for 55,000 in 2020 and paid AED 5,000 fine penalty from the court to remove the case.
Now the bank is contacting me regularly asking to settle an amount of AED 400,000.
Can they put a case for the entire amount? or the amount which I really owe them?
