The landlord wants to increase the rent while the tenant refuses. What to do?

Dear questioner,

I don't want to renew the contract of my tenant and he doesn't want to move. What do I do?

I have sent him a notice of rent increase 90 days before the end of the tenancy contract.

I told him in an email that the rent will be 55000 AED and he wants to pay 48K only.

Dear questioner,

If the increase of the rent is as per the RERA index, you can increase the rent since you have notified him in writing to increase it.

So, he won't have any other option but to either sign it or leave the property by giving you notice as per the tenancy contract.

Thank you for your answer. He accepted to increase the rent up to 20% of the RERA index which is the maximum I can do, right?

Because if I increase the rent by 20% the rent (AED 33600) is still below market and the market is at 45k. So what shall I do?

Legally, you will have to follow the RERA index. The other option you have is to serve him a notary notice for vacating the property to sell at the time of renewal of the contract.

Once this new contract gets over, you wait for some time and put it for the rent again with a higher rent.

So according to RERA, I cannot increase rent more than 20%, right?

Also, you said I give him a notary notice for vacating the property to sell at the time of renewal, so I have to renew then?

Does it mean I renew then i give him a notary notice? And when can I vacate him after giving him a notary notice?

For eviction, you need to provide 12 months' advance notary notice.

You cannot ask him to vacate now so, you will have to renew the Ejari and at the same time give him the eviction notice.
