Requirements and fees for opening a branch of foreign company
Dear Sir
We are a Saudi-based company registered in the UAE as a branch of GCC.
We are in process of signing an agreement with a software developing company based in India as a sole distributor for their products in GCC.
Can you let us do procedure and legalities?
Secondly, do we need to register for VAT since some sales are for the Saudi market?
Do we need to charge VAT for sales done in Saudi through us?
Looking forward to your reply
Regards,
Imtiyaz

1. The procedure is that you will have to do an MOU with the Indian company based on the UAE laws and have the jurisdiction as Dubai courts or DIFC.
We can help you draft a suitable MOU to protect your interests wrt intellectual property, data protection and privacy-related laws as well as NDA and NCAs.
2. You will need to register for VAT since you will be buying or selling within the UAE, so you will certainly need a VAT number if you are selling to clients within the UAE.
If you want us to help you with your setup formalities you can write to us on advocate@alriyamiadvocates.com
Thanks.
