Q: I would like assistance in getting out of a Regus Business Centre rental agreement, which states that I am liable for the entire year's rent when I had asked for a cancellation early into the contract when my investor for the company had backed out.
Is there any way to do so or at least negotiate a small cancellation fee?

Early termination of a lease without a proper tenancy agreement

Q: Hi,
A security deposit of AED 3,500 was paid to the landlord when I moved in and rental payment for each month was monthly. I moved out for personal reasons 4.5 months later and all rental payments were made for my time there.
At the time of viewing the room, it is being claimed that the landlord stated the minimum term was 6 months, which was never put in writing or was it ever confirmed I would lose my deposit even when I gave my 30 days notice. There is no contract or correspondence to confirm any of this.
The landlord lives in the property and is refusing to return any of my deposit. She is ignoring me now by blocking my number. I even offered her just over AED1,000 as a pro rata settlement as a goodwill gesture, but that is when she blocked me after she read it. I refused her 50/50 offer.
If filing a complaint can cost AED 2.5k-3k where do I stand it seems like a pointless exercise, I don't think RERA will look at it? Do I go to the police? I'd prefer to avoid this option.

Settling bounced cheques issues with creditors to avoid a lawsuit

Q: Hi.
I had some emergency in the last quarter of 2015, and I had to go out of Dubai. Then I faced some problems and was unable to come to Dubai in time. Some cheques that were issued by me had bounced, and I have some questions.
I issued a cheque of AED 75000 to somebody but managed to pay only AED 50000, and I have the receipt as well. He agreed that I can pay the rest when I come back to Dubai. I have a receipt only on a plain paper, can he make a complaint against me to pay him the full amount of AED 75000?
Three of the cheques I paid against renting two flats, were also bounced. The amount of the first cheque was AED 20000 and the remaining two were AED 12000 each. I contacted one of the real estate agents, and it looks like he currently has the original cheque with him. Does this mean that he did not opt to make a lawsuit?
After paying the dues, do we need to go to the Police station to clear the case and make sure there is nothing against me?

Seeking advice.
Our landlord filed a financial case against our so called bounced cheque.
However, we left the old flat, and they are still holding our PDC and kept on sending it to the bank.

Q: Hi Sir,
If a person paid his all cheques penalty at court and got free from there, can the estate agent put another new rent case on the basis of tenancy contract?
The rental amount was already paid in court in 2018 and the person was free from court. Now again the same case. What should the person do?
He has all the documents and proof of payment of cheque and Baladiya (municipal slip) too.

Is the tenant obliged to provide PDCs if it is not mentioned in the tenancy agreement?

1. The Lease Agreement for apartment rent states to be paid in 8 cheques. no mention of PDC or to give cheques in advance.
2. Lease does not specify that the cheques have to be given in advance or that they are to be PDC's.
3. I am up-to-date on my rent payments.
4. As the lease did not specify cheques to be given in advance, I give them on a timely basis as and when due.
5. The landlord is demanding that I give the balance cheques as PDC's and claiming it is a breach of contract.
6. The landlord is giving a 3-day notice to comply with the PDC's or else pay the full balance of the rent.
7. The landlord is refusing to give me the landlord's counter-signed lease copy.
8. I am neither in default nor behind on rent - how can he threaten me with a 3 days notice and demand PDCs when the lease did not ask for the same?

Changed my mind before signing the lease agreement. Are my post-dated rent checks at risk?

Q: Hello,
I recently found an apartment for rent and agreed with the agent to make payments in three installments.
I provided the agent with post-dated checks for the second and third payments and planned to transfer the first payment, deposit, and agency fee to the agent’s account once the lease agreement was finalized.
However, the lease agreement has not been finalized yet, and I have since found a better place. Since I have not signed any lease agreement, should I be concerned about the landlord cashing the checks for the second and third payments? Is it legal?
Additionally, the agent requested an extra 2,000 dirhams beyond the amount he intended to include in the lease agreement.

I have two questions:

(b) The second question is, do I have to renew the rental agreement for 3 months (until December 2024) or not?

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
