Q: I went to a hospital to have a medical check-up as I had a weird feeling, they ran the tests and they told me that I am fine and nothing is wrong and that I am cancer free. A year later, I went to the same hospital as I have been informed by another hospital that I may have breast cancer, they ran the tests again and they said it is a benign tumor.
However, when I traveled back to the US and had another check-up I was informed that the tumor is malignant. I had to go through surgery and chemotherapy and be absent from work for a long time to get the treatment. I was also informed that if I had known about it the first time I was diagnosed, there would have been a better chance to cure it at early stages.
Can I claim for compensation from the hospital for negligence and how much can I claim for?

Q: Hi.
I won a DHA ruling of malpractice against a Dubai-based dental clinic and need to go to court to recover the money I paid out.
I’m also hoping for some compensation for the year of pain and inconvenience I went through as a result. I'm told that I have to pay 6% of my claim up front. How much should I claim?
I spent AED 30,000 on the original dentist and AED 80,000 correcting the problem. I gave a statement as part of the malpractice case.
As I have already won this, do I still need a lawyer to represent me, or would the judge use my original statements?
I appreciate any advice on this matter.

Medical negligence and a lawsuit for compensation

Q: Hi,
I had a treatment with a machine called HIFU to treat the wrinkles on my forehead, the treatment was so painful, and immediately after, I had 2 large depression on both sides on my forehead and a vertical line in the middle.
The company denied their mistake and they are ignoring my calls since the 26th of July 2018. Please note that I was not given any consent form to sign.
After consulting a dermatologist, he confirmed that I had an atrophy fat melting and muscle oedema due to this treatment and I have a medical report.
I have taken a picture before and immediately after.
Kindly let me know what to do.

I had put a question here regarding an option to sue a hospital in DHCC area for a surgery that's gone wrong and caused bowel perforation, infection,...
Now, 3 years have passed since the surgery time, July 2017. Any chance I can still start an action against the hospital?
I know it is only 3 years to take an action.

Filing a complaint against a doctor due to misdiagnosis of a life-threatening condition

Q: I was treated for a collapsed lung in May 2019 at a hospital in Al Ain.
I was told that I had a spontaneous pneumothorax. In January 2020, I was treated for a second collapsed lung. I went to the first hospital to get a medical report.
The report said that there was evidence of a rare cystic lung condition, Lymphangioleiomyomatosis. I got my biopsy results from the lab and saw that they had tried to inform the doctor but no contact was able to be made.
I then asked the doctor why I hadn't been told about it and she shrugged and said that they told her it was nothing.
I asked: "do you know the rare, life-threatening, cystic lung condition?", she said: "of course yes!"
I am now suffering from poor oxygen diffusion symptoms, agonizing lung pain, requiring oxygen therapy, and will be starting medication to hopefully slow the progress of the condition.
If I had known earlier, I could already be on the medication to give me a better quality of life. What will I achieve by laying a complaint?

A simple blood collection sample resulted in the incapacity of performing my daily work routine. The medical technician who collected the sample refused to admit that she has actually pricked me with a needle, and the Doctor and Clinic Manager is backing the medical technician's story.
I have a bruise on the jab area on my arm which verifies that the actual pricking of the needle has been carried out.

Q: Hi,
A patient has filed a civil case against me after he developed a clot which the radiologist misdiagnosed and said that it was not there. It is a well-known complication of any orthopedic surgery but treated by a vascular surgeon.
I followed all protocols and DHA said since the patient was originally mine, I should have paid more attention but no action was recommended against me. Based on this, the patient filed a civil case against the hospital as the report also said the hospital is responsible for hiring an incompetent radiologist.
I no longer work for this hospital and they asked the court to include me in the case too. What are the usual compensations awarded by the court if there is no loss of life or any body function?
And will medical malpractice cover it, if so which one; my current one or the one that still insures the hospital?

What is the impact of a patient complaint on the license of the doctor?

Q: In a case of a complaint filed against a doctor as the patient was unable to move one finger after stitch was put to close a wound, the MOH medical committee gave the verdict that:
There was a damaged tendon as part of the original injury sustained by the patient. This was missed by the doctor while putting the stitch.
Hence,
1. There was negligence from the doctor
2. There was a medical error
We are now waiting for the penalty assessment for this verdict. How will this verdict/penalty affect the UAE General Practitioner license of the doctor?

There was a gas pipe explosion in our building and the whole floor is unhabitable.
So we are located on another floor, gas usage was cut and had to rely on electric plates which takes longer time to cook and there is the fear of fire if left unattended.
Gas will be reinstalled after 3 months and we wish to terminate the contract early because we cannot use the gas which is one of the facilities we agreed for in the contract and we feel unsafe in the building because every now and then the alarm goes on.
They gave us an option to move to their other buildings but will even be farther from work plus the transportation costs will increase.
Do we have to pay penalty charges for a situation that is not our doing? We are already having heart palpitations whenever there’s an alarm?

Good morning,
We have given an employee a final warning due to attitude and creating fights with employees.
Last time, she did the same thing after that she left the office early without informing the manager (she informed the owner of the company which is not the direct report) after that she was absent for 2 days without informing the same.
She sent a message to the owner of the company, but the owner did not reply nor approve her reason for being absent.
Is it valid that I serve her termination?

I'm an Australian non-Muslim expat resident for 10 years. My wife is the same, as are our three children, ages 19,16 (girls) and 11 (boy).
I have opened a case for divorce in Australia, and the hearing is in November. My wife wants to take me to court in the UAE regarding child maintenance.
I currently pay 35% of my monthly salary to my wife for child support. She wants more. I am due to leave the country next July permanently.
If she opens a court case, will that stop me from leaving? Has she got a case for more money?

My question is about my son who has a travel ban for the past four years.
I am a divorced woman and the travel ban is from his father. I want to move back to my home country as I don't have any emotional or physical support here.
My parents are old and would like to move back for good. I have tried discussing this matter with his father but unfortunately, the matter is still unresolved.
