Application of the eviction notice served to the tenant before the contract renewal
Hello,
I served my tenant an eviction notice on 5 Dec 2021 to leave the property.
His tenancy contract was to be renewed on 5 Jan 2022 and I renewed it for the period of 5 Jan 2022 to 6 December 2022.
So is it fine as I am giving him 12 months to evict the property (notice on 5 December 2021)?
Or do I need to make it 5 January 2021 to 5 January 2022?
Some rental agreements require that a notice be given if the relationship between the landlord and tenant ends.
If you want to end the agreement early, use the lease termination letter to formally communicate the need to terminate the agreement.
For example, an annual rental agreement may automatically renew unless one or two months' notice is given.
An advanced warning gives the landlord time to find another tenant and gives the tenant time to find a new home as per the law.
Some rental committees in each emirate in the country require that a minimum number of days' notice be given to the tenant before terminating the tenancy contract.
Prepare an eviction notice with the minimum legal notice requirements for periodic rentals.
In cases where the landlord is going through the eviction process with the tenant, a court notice or agreement shows that the landlord has given fair warning.
Hopefully, the landlord has documented all letters and written notices sent to the tenant. A good paper trail can save the owner's time in the future if the judge steps in.
