Q: Dear Lawyers,
I would like to bring to your kind attention that a month back I have won a case against my employer of AED 120,000. After 10 days of the first instance decision, my employer had filed an appeal.
In the appeal, he has mentioned that he was not given a fair chance to explain the appointed expert. He wants to reopen the case and refer it to the same expert and explain to him all the important points which he missed.
The court has given the first hearing date of appeal. My question is that can the judge dismiss his appeal after the first hearing as his appeal is based on some ridiculous charges on me?
I would like to avail your respective services to handle this appeal. Please advise how much will be your charges for the above-mentioned issue.
Looking forward to hearing from you guys soon.
Regards.

The following steps after getting the first instance court judgment in a labor case

2
Q: My previous employer refused to pay me. I launched a case against them. After multiple rounds of court, a judgment was made. Although I didn't get what I had hoped/claimed, the employer appealed against it.
The appeal from my ex-employer was made on 24th March. Given the current situation globally, does anyone know what are the next steps? Do I have to go to court again? Is there a hearing date? Do I need another lawyer to present my case again? What paperwork do I need?
Anyone, please help!

The procedures and time frame of appeal in a labour case
11
Q: Hi there,
I have won the labour case against my employer with an amount of AED 75,000, regarding salaries issue. Now, my company has filed an appeal request to appeal the court judgment.
My question is, how much time will Dubai appeal court take? What documents do I have to provide? Can I claim more amount due to the waste of time or having no job?
Please reply to me.
Best regards

Ex-employer appealed the case. Can I add further translated evidence?

1
Q: Dear Sir/Madam,
My former employer appealed a 1st instance court case, which I won, awarding a sum of 96,000 Dirhams. Now, I need advice on the following:
1) Am I allowed to upload further memoranda and evidence, already in my possession and duly legally translated?
2) Under the New Labor and Civil Procedure Code, can I appoint an Emirati Lawyer?
3) As I am not an Arabic speaker, I will need a translator for the Court. How can I request one prior to my first appeal hearing?
4) Could you assist me with a percentage fee based on my aforementioned reward from the first court instance?
I am awaiting an urgent reply.
Thank you for your kind attention and best regards!

View allCan the landlord request the tenant to pay the chiller in the middle of the contract? 0
I live in Dubai Marina, and the landlord claimed that according to new Dubai Land regulations, the chiller now has to be paid by the person occupying the apartment.
Even though my contract says that the landlord should pay the chiller, they want to implement this mid-contract.
I understand that the terms upon renewal will be renegotiated, but on what grounds can they implement the change mid-contract?
Does a new DLD regulation precede a tenancy contract? Moreover, I am receiving a disconnection notice from the chiller company due to non-payment.
What can I do if this happens?
Please advise.

Cleaner's resignation with 30-day notice in incomplete contract 0
Hello,
Good afternoon!
My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months.
Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it.
I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month.
Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

The ownership of a code of a web application 0
Hello,
I represent a tech-based marketplace company registered in a Freezone, in the UAE.
This is in regards to the UAE's law regarding the ownership of code when there is no clause mentioned in the agreement. One of our products (web application) is being developed by an agency in the UAE.
While we do have agreements in place, there is no clause regarding ownership of code. In the situation mentioned above, I've heard that the ownership of code either goes to the author or the agency that employed the author. Is this true?
Your assistance and help would be of great help.
