Can the employer file counter criminal or civil cases against a labor case by the employee?

Hi,

My query is that my husband and his 3 colleagues won a criminal case that was filed against them by their employer accusing them of theft and cheating. The employer has not paid full salary and gratuity and has harassed them a lot for 18 months.

My husband and his colleagues want to claim everything by filing a case in labor court. Are there any chances that the employer can file any other case in civil court against them?

The Dubai court has already dropped all the criminal charges that were put by him on my husband.

Can they move forward with filing the other case in labor court?

Is there any risk from the employer?

Since the employer has not paid full salary and the EOSB, your husband has full rights to raise the concern to the Labor.

At the time of filing the case, he can mention all details of the events with the employer.

Respected mam,

We have concerns. Somebody told us that if we file a case in labor court for claiming our full compensation which amounts to approximately 50-55 thousand dirhams per person for 4 of them..then the employer can also file a case in civil court. Is it true?

Can he file any case against us? If yes, on what grounds?..

I want to tell you that all the criminal charges against my husband and colleagues have already been dropped or nullified by the honorable court since all charges he put on us were false.

My husband sincerely worked in his company for 4 years. But since they were not willing to work for long hours on less salary, he framed false criminal charges against them.

We have suffered a lot at that employers' hands. He used his power and money to bribe our previous two lawyers.

It's been 1.5 years that my husband and his colleagues were stuck in that case without any job. They have faced very very hard times.

We fear he may find any other way to harass them as he is very revengeful towards us from the beginning.

Please clarify ma'am. After we have won the criminal case, can he, in any way, file any other case against us, civil or any other type?

For filing any civil case, there has to be some ground. We can't predict this.

Moreover, your husband should file a labor case only for himself not collectively.

Ma'am, my husband was an honest and hardworking employee. He never did anything wrong.

Whatever he framed against us was false and made up, he even bribed our previous two lawyers with a heavy amount so that we can never get out of this.

It took long 18 months to get out of this. We have suffered a lot financially and mentally.

I guess he has no more grounds since criminal charges against us have already been cleared.
