Q: My insurance company (Oman Insurance) took 22 days to get an estimation of the reason being major damage.
I inquired for a total loss and they said no as there was no chassis damage and the estimate was awaited. On the 24th day, I received a total loss offer letter from Oman Insurance asking to sign and acknowledge.
I accepted the offer and sent back the document. 2 days later the garage told me that they were working in the car based on the word of the estimator in spite of no LPO.
Oman insurance calls me and says that there was a miscommunication and the garage brought down the repair charges from AED 50000 to AED 20000 and that they will now proceed to fix the car.
I did not agree with them as I found that the car had a chassis damage. Oman Insurance changed tune all of a sudden to the car only having minor damages and the chassis will be fixed.
Can the insurance company take back an agreement on free will when an offer is accepted and has the company signature, seal and trade license?

What can I do if the car service does not fix my car and keep taking money?
5
Q: Hi,
Hope you are doing well.
I was just wondering if it is legal for a company to provide a positive google review about themselves.
I have been dealing with a car garage and I think they are taking advantage of me and letting me pay for their mistakes, brought the car in 4 times already and spent more than AED 4000 and now it's still not fixed.
Am thinking to file a complaint with consumer rights. My last bill didn't specify anything, just "labor 1000dhs" but not on what was done (change of rubber and oil top-up).
And now I see the guy who is in charge of my car/working on it, left a good review about the garage as if he was a customer while he works there. Is this even legal?
Thank you.

Responsibility of the insurance to guarantee car repairs after an accident
2
Q: Good day!
I've had an accident a month ago and I took my car for repair and have signed a paper to proceed for repair under the advice of my insurance company.
After 1 month, I checked the status of my car and the repair shop asked me to transfer my car to another shop.
I drove my car for transfer I noticed that my car has some humming sounds, and it is shaking/having some vibration when it is accelerated to 60. I informed the shop and they said it will not be under insurance.
Now, what I am asking from my insurance company is to just make my car roadworthy and without the vibrations/humming sound but they are refusing as they are saying it was because of the normal wear and tear and not because of the accident.
But before the accident, my car didn't have any issues like what it has now.
My question is, do I have any right to ask the insurance to make my car roadworthy before it is released from the repair shop?
Thank you

How to claim the full price of my car that got damaged in an accident not due to my fault?

1
Q: My car got damaged in an accident, and it was not my fault.
The insurance said they will cancel the car and give me AED 5,500, whilst the car value on Facebook maybe is AED 12,000. The sum insured as car value is AED 7000 with insurance
Can't I claim pre-accident condition whatsoever the value of repair as it is not my fault?
I believe that the faulty party insurance must pay for all the damages that happened to my car due to the others' fault.
Why do I have to bear losses in depreciation and cancellation?
Please advise.

Can the car rental take compensation from me if I have a car accident?
1
Q: Hello Everyone,
I took a car from a car rental in 2021 and someone hit my car when I was at the red signal light.
I raised the police complaint and got the green report saying the damage to the car should be borne by the insurance. I sent the same response to the car rental but they still keep asking me to pay and they are charging me AED 2500.
I asked them for the reason but no response from them. After 2 years now in 2023, they hired an agent who is sending me emails and asking me to pay the money.
When I referred him to the previous conversation he is saying as per the car rental's terms and conditions, I have to pay the amount.
Appreciate your advice.

Insurance claim rejected for flooded car - How to appeal?

2
Q: Dear Sir/Madam,
I filed a complaint with the Insurance Authority against an insurance company because my car got flooded.
The case was escalated to the dispute resolution committee, which denied my compensation request because the car was first declared a total loss, but later it was found to be repairable.
I want advice and to know how I can appeal this decision.

Unfinished motorcycle repairs and unfair fees at a workshop: What to do?

2
Q: Dear Sir/Madam,
My motorcycle was taken to a motorcycle workshop for repairs due to a coolant leak.
After examining the bike, they provided me with a quote and later informed me that the oil and water had mixed, necessitating an engine flush.
Although hesitant, I trusted their expertise and paid an initial fee of 5900 AED. Unfortunately, it has been two months since the deposit was paid, and the repairs are still unfinished.
When I recently followed up with them, they informed me that the bike lacked compression and power and needed new piston parts.
This seems implausible since the engine was running smoothly before the rebuild.
It appears that the mechanic did not properly assemble the engine initially, and now they want to charge me an additional 10000 AED to fix their mistake.
They continue to increase the cost and make excuses for the delay, even though it should not take three months to rebuild an engine.
What are my options?

Can the other party in a car accident ask me for money if my insurance does not cover third-party repairs?

1
Q: I have fully comprehensive car insurance with agency repair and just had an accident in Dubai where it was my fault.
The other car is a [-----] with a warranty and my insurance has approved their claim but won’t let them get the repairs at the agency.
It turns out the agency repair on my policy is for me only not for third parties.
Now the [----] warranty becomes void if they don’t go to the agency which my insurance won’t cover so the [----] owner is asking me for the money now!
What do I do?

View allDisputing tenant's refusal to accept old landlord's rent increase notice 0
Hi,
We recently bought a villa in Dubai. We are looking for an advocate for legal advice.
Even though the old owner gave the tenant a 90-day notice about the new rent, the tenant is not agreeing to the notice because it didn't come from us.
Since the renewal is in October and we bought the property in September, we don't have 90 days to notify the tenant of the new rent.
The tenant agreed to the new rent in an email with the old owner 90 days ago. Can we dispute this?

We had an accident. Can I claim the treatment costs paid to hospital from the insurance? 0
My family and I had an accident. The incident occurred the very next day of their arrival in the UAE on a residence entry permit and their visa//health insurance was still in process.
With gods grace, everyone was discharged from the hospital on the 3rd day after many tests and keeping us under observation. We were slapped with a hefty bill as my family was not holding any health insurance.
What are the chances that I could claim the medical expenses through the vehicle insurance, as it covers co-passengers as well?

What can I do if a company hired me then changed their mind? 0
I am working in a company and their management is the worst. They made an interview in India and called me.
After calling me here, they again made interviews and made me work for 1 month. And now, they're telling me I am not capable of work and they are mentally torturing me.
I have given them 1.5 lack in office in India and here they are not paying me any salary. I am going into depression as I am not getting any solutions.
The only solution coming to my mind is a suicide, I don’t have any other options left. I have taken money in interest and people are daily coming to my house for money.
Please guide me in a proper way on what I can do.
