How to get divorced in the UAE while the marriage contract was signed in Belgium?
Dear sir/madam,
The new laws stipulate that the divorce laws of the country of origin in which the marriage has taken place apply.
Now, to put it bluntly, how do one's parents go about getting a divorce in the UAE when the marriage contract was signed in Belgium?
Secondly, what happens to the children if two of them are considered "majors" and the other is a "minor"?
Lastly, if possible, could you provide me with a brief overview of the divorce process in general, considering the aforementioned information provided?
Thank you!
Hello,
Yes, the law of the parties can be applied in the event of divorce, but the two parties must choose that law, and the law must be followed and applied in the Emirates.
As for the UAE law, it is different because it applies the Islamic Sharia. The children are subject to the mother’s custody for a period of 11 & 13 years for males and females, and the alimony is borne by the father, after which it is transferred to the father, and the custody ends with the son’s marriage, employment or reaching 21 years of age.
