Non-renewal of limited contract and possibility to use the annual leave for the notice period
I am on a 2-year limited contract. I informed the company early that I will not be renewing my contract once it finishes.
Now, they are refraining to allow me to take my plotted leave. They said they are not allowing their employees to take leave during the notice period. Is this legal?
I cannot see any notice period in my contract. It only says to refer to the annex if I will terminate my contract early. Annex says just to pay 45 days of salary.
Does this mean there is no notice period for my contract?
Thanks.
Hello,
It is true that it is not permissible to combine the leave and the notice.
But you have to stick to your rights, and if the notice period is not specified in the contract, the law can be applied.
And you can get the paid legal advice to inquire about it more.
