As per our understanding, you have paid 20 per cent down payment and a deposit for two studio apartments in 2008 and you haven’t received the contracts despite contacting the developer, therefore, you wish to receive a refund for the same.

Based on the information provided by you, the developer has failed to comply with the law, you are entitled to receive your advance payment.

Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai, Article (20) :

The purchaser may apply to the relevant competent court to terminate the contractual relationship between the purchaser and the developer in any of the following cases:

1. If the developer refuses, without any reason acceptable to the Department, to deliver the final sale agreement of the Real Property Unit to the purchaser;
