هل من الضروري إرسال إشعار بعدم التجديد قبل 30 يومًا من انتهاء صلاحية العقد؟

سيدي العزيز / سيدتي العزيزة،

انتهى عقد العمل الخاص بي في 16 ديسمبر، ثم أرسلت خطابًا إلى الشركة يُفيد بأنني لن أجدد العقد، لكن الشركة أخبرتني أنه نظرًا لأنني لم أرسل لهم إشعارًا قبل 30 يومًا، فإنهم سيخصمون 30 يومًا من راتبي.

هل هذا الأمر يُعد قانونيًا رغم أنني أحضر للعمل وأنهيت ست سنوات من الخدمة لدى الشركة؟

Unfortunately, you have not mentioned the nature of your employment contract.

Please be noted that if it is a limited contract, you may serve a notice of non-renewal to terminate the contract as per article 113 of the UAE labor law.

An unlimited contract is a continuous contract with no expiry and hence you cannot serve a non-renewal notice for an unlimited contract.

As stipulated in the agreement or as per the law you shall serve a notice period of 30 days, otherwise, you shall compensate the employer in lieu of the notice period.
