Q: I had invested in an off-plan property with a developer paying 30%. A year back, they offered me some discount to pay the balance (70%) in advance of handover mentioning it will be in May 2018, which I foolishly enough did. The official handover date was March 2018. So it is delayed by more than a year grace period and I have not been notified in any way about any delays. They are no longer responding to emails. The project shows completion of 82.18% at the land department website, but going by construction on-site, looks like it will take another 6-9 months, if not more. Questions: - Can I claim a full refund for money paid with interest? - How much time does the legal process take because I have been told by some friends that the developer can drag the case for years? - Any other option that I have as an investor to deal with a powerful builder? Appreciate any advice that you can offer. Happy to share the documents for review.

س: مرحبًا، اشتريت عقار من مطور ودفعت نسبة 24% من المبلغ في سنة 2015، إضافة إلى حجز عقارين من المطور نفسه. تم إلغاء حجز العقارين وتحويل أموال الحجز إلى العقار الذي دفعت فيه نسبة 24%. تم التعاقد معي على أن يتم تسليم العقار في سنة 2017، وبعدها قاموا بالتمديد لمدة سنة حسب العقد، على أن يتم تسليمه في سنة 2018. تواصلت معي شركة المطوِّر لإخباري أن العقار الذي اشتريته في الوحدة المذكورة في المشروع المحدد تم إلغاؤه. قمت بمراجعة دائرة الأراضي والأملاك ولم يفيدوني بشيء. راجعت شركة المطور ولم يتم إثبات ذلك. راودتني الشكوك ولم أكمل معهم الدفعات المتبقية. فوجئت بإلغاء العقار عن طريق دائرة الأراضي والأملاك رغم تقديمي شكوى عن الموضوع الذي طرحته من قبل بشأن إلغاء الوحدة في المشروع. لم أتمكن من استرجاع أموالي بأي طريقة حيث قام المطور بالانتهاء من العقار بنفس الوقت الذي تم فيه إلغاء العقار من اسمي وتم بيعه لطرف آخر حسب ما ذُكِر لي. يُقدَّر المبلغ المدفوع بمبلغ 700,000 درهم.

Q: Hello there, I want to understand if there is any form of consumer rights protection for customers under real estate projects. I have paid for 80% of an off-plan property which when we put a down payment 5 years ago was supposed to be a premier luxury community. Over the years, the community has dropped many of the features of what was marketed like a rain forest and greenery. Currently, it's not only the community that was marketed on their brochure but quality and finish are also extremely poor. Simple things like fire alarms or sprinklers which I thought to be mandatory for villas in the UAE aren't put. They have been harassing me to make the final hand over and final payment. Even though, we have told about the never-ending snags and even missing sqft and basic layout of the townhouse. I didn't expect this from a prime builder. We chose to take a sustainable green community even though far from the city assuming the luxury and finish would be there. Extremely disappointed and feel scam. Please advise!

س: السلام عليكم، اشتريت وحدة سكنية من مطور في دبي سنة 2014، ووقت التسليم حسب العقد هو 2018، لكن بسبب تأخر تسليم المشروع إلى اليوم في ٢٠٢٢، طالبني المطور بدفع ضريبة الفات (VAT) كاملة رغم أني اشتريت ودفعت غالبية المبلغ قبل إقرار قانون الفات. أدى تأخُّر المطور في التسليم، حيث أنه لم يُسلِّم الوحدة في بداية 2018 كما مكتوب في العقد، أدى ذلك إلى المطالبة بضريبة الفات. هل يحق للمطور المطالبة بالضريبة؟ علمًا بأن الوحدة السكنية شقة فندقية.

عرف قانون المعاملات المدنية الإمارات في المادة 872 منه عقد المقاولة بأنه العقد الذي يتعهد فيه أحد طرفيه بأن يصنع شيئاً أو يؤدي عملاً لقاء بدل يتعهد به الطرف الآخر. وينقضي عقد المقاولة إما بانقضاء العمل المتفق عليه أو بالفسخ، وفي الحالة الأخيرة، يتم التعويض على الطرف المتضرر من الفسخ كما هم معمول به قانوناً وعرفاً.

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
