The tenant did not send an eviction notice as per the contract. What to do?

Hi,

The tenant in my apartment did not give the 3 month-written notice as per the contract. The contract expired 01/10 and he called me on 28/09 to say that he wants to leave!

I didn't take the keys and sent an official court warning to pay the penalty and the rent as I did not take the apartment keys even although the contract expired.

After one month, no news came from the tenant! The next step is opening a case.

What is the best strategy to make sure he pays my rights?

Since the tenant did not serve you the written termination notice as per the contract, the contract deems to continue in full force and he will have to pay the rent for all these months.

If he is still not paying, you will have to open a case.

Dear questioner,

Since the tenant did not give you prior notice, the contract remains in force.

You need to file a case with the RDC to get your rent until the month of final eviction as per the court decision.

Dear,

1- First of all, it is so important to know which Emirate your apartment is located in because the law is different between one Emirate and another.

2- In general, as long as the tenant did not hand over the apartment, and once the tenancy contract is expired and the tenant did not send a notice to you for his intention to leave in time, it means the tenancy contract has been extended to the same period by the same terms and conditions. Therefore, the tenant is entitled to pay the rent in time, otherwise, you can file a case against him.
