س: سلام عليكم،
أنا اشتريت ٣ وحدات عقارية من شركة كبيرة بدبي وكان العقد بتاريخ ١١/٢٠١٥ وتاريخ التسليم ١١/٢٠١٧ ولم يتم اكتمال المشروع إلا في ٥/٢٠١٩ وحدثت خسائر مادية بسبب تغيير أسعار العقارات بالإمارات والأقساط المدفوعة للشركة مقابل الوحدات مما تسبب في خسائر مالية.
سعر الوحدة بتاريخ ٢٠١٥ كان ١٥٥٠٠٠٠ درهم وحاليًا بسعر ٩٠٠٠٠٠ درهم مع العلم أن المساحة الكلية للعقار أقل من المساحة بالعقد بمقدار ١٥ متر بعد الكشف على مساحة الوحدات من قبل خبير عقاري.
هل يمكن إعادة مبلغ الوحدات وفسخ العقد؟ وكم نسبة التعويض في هذه الحالة؟

س: تم شراء وحدتين من شركة تطوير عقاري. موعد التسليم شهر 6 - 2019 وإلى الآن لم يتم التسليم. تم التواصل معهم واتضح أن بإمكانهم أو أن القانون يسمح بتأخير لمدة 15 شهر بعد الموعد المتفق عليه في دائرة دبي.
أرغب في فسخ البيع. الرجاء إفادتني كيف الطريقة علماً بأن إحدى تلك الوحدتين لم يتم تسجيلها في دائرة الأراضي والأملاك بدبي.

التصرُّف السليم عند إخلال المطور العقاري بالتزاماته

س: اشتريت وحدة سكنية من مطور عقاري في دبي عام 2015 وكنت منتظم في سداد خطة الدفع ودفعت إلى الآن 81% من قيمة الوحدة، وكان موعد التسليم في يوليو 2018 وفترة السماح 12 شهرًا حتى يوليو 2019.
لكن حتى الآن، نسبة اكتمال المشروع هي 76% فقط وقام المطور بتمديد تاريخ نهاية المشروع عدة مرات وآخرها إلى سبتمبر 2020. بناءً على العقد، فبعد فترة السماح، هناك غرامة لا تزيد عن 4% من المبلغ المدفوع عن كل سنة بعد فترة السماح. تواصلت مع المطور وأبلغني بأن المقاول تأخر في المشروع.
نصحوني أن أقوم بالترقية إلى وحدة جاهزة وأكبر ومفروشة ودفع الفرق بين الوحدتين. وطلبوا مني حجز الوحدة الجديدة المختارة بمبلغ 20000 ريال، وفي حال لي يعجبني السعر من لجنة الإدارة بعد خفض سعرها، فسوف يضاف المبلغ (20000) إلى حساب الوحدة السابقة التي لم تنتهِ بعد.
لكن طلبوا أمر لم أوافق عليه حتى الآن؛ وهو بحكم أنني اشتريت الوحدة عام 2015 بسعر عالي وسعرها الآن خسر 200 ألف تقريبًا، فسوف تضاف 200 ألف على سعر الوحدة الجديدة. ومضى على هذا التواصل 20 يومًا تقريبًا ولم أجد إجابة منهم بخصوص الوحدة الجديدة أو مبلغ 20000.
هل هذا العمل قانوني أم لا؟
وكيف أحصل على حقي من المطور العقاري؟

I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:

How is the probation period calculated exactly from the date of signing the contract? 0
Regarding the probation period, when is the deadline for an employer to terminate me if the DOJ anniversary is Friday 2nd Feb?
Will the six-month period end at midnight on the 1st, therefore completing six months, or can the employer still terminate on the 2nd?

I'm staying in JLT in a house with a rent of AED 140,000 per year. The lease starts on 1st Sep '23 and expires on 31st Aug '24.
The landlord sent me a legal notice from the Dubai Courts in mid-Sep '23, giving me 1-year notice to vacate the house as he plans to sell the house. The notice was received by me through email from the court.
He claims the email notice sent by the court is not valid till I receive it by courier via Aramex for my physical signature. Can you please confirm if this is true?
The landlord is now ready to let me stay in this house for two more years. He has proposed that we maintain the existing lease agreement and Ejari. However, I should pay him AED 14,000 in cash (10% increment).
We will sign a separate paper document wherein we will agree that I will further rent increase of 10% (10% on (140,000+14,000)) on 1st Sep'24 when my current lease expires.
Should I insist on making a fresh written contract with the higher rent (140,000+14,000=154,000)?

I have signed Form F and got the mortgage but the seller is in breach. What to do? 1
Hi
I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023.
When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual.
Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress.
So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller.
So I need to ask the following:
1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23?
2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller?
3. What is your advice?

I own an apartment in Dubai and served the tenant a legal eviction notice through Dubai courts in March 2023. The reason for the eviction notice was that I was planning to move into the apartment.
However, my circumstances have changed, and the original tenancy contract end date is December 2023. The tenant has now requested a one-month extension of the contract until January 2024.
Can I revoke the eviction notice that I have already served?
