Q: I was in a process of buying a property in Dubai from a developer. Their sales representative advised me to put a deposit of AED 10,000 to reserve the unit. We agreed the value can be fully refunded if I cancelled within 10 working days. A few days later, I requested to cancel my reservation and refund my money back. They refused to refund my money back. I have supporting documents which prove my agreement with them in the form of: - The email in which I reserved the unit list the terms & conditions (which I have written) - I have an updated payment form from them and hand wrote the condition of unit reservation (full refund if cancelled within 10 working days) - Exchanged WhatsApp with their sales representative. They claim that the above proofs are not enough to support my claims, and so they are refusing to refund my money back. Please share your thoughts on my email [--------------------].

Q: Hi, I had booked two villas with a developer and paid them the booking fee of 40000, 20000 each. After which, due to certain circumstances, I had to drop the idea to proceed ahead with the purchase. Checking with the developer's sales representative, he said it is not possible to get a refund. What are my chances to get a refund in the above case? I did not sign any document, just have the receipts of 40000 paid on different dates.

Q: I have purchased a property in Dubai in Dec 2017 by putting a 30% deposit of the purchase price to the Developers account and received the reservation form and receipts only. However, I still do not have the SPA or OQOOD as of Aug 2018. The developer has been saying the SPA templates have been getting delayed at DLD. Per the reservation form, I have an upcoming payment in Sep 2018, however, I do not want to pay this as I still don't have the SPA or Oqood which is my legal document and there is no escrow account per DLD website. What is my legal position here and how can I get this resolved or can I get refunded given there is no contract as yet? Please guide

Q: Dear Sir/Madam, An investment company in Dubai has consistently been late with almost every payment of interest due every six months. They do not acknowledge that the payment is late, even though the certificate states that it will be paid on 10 May and 10 Nov each year from 2020 to 2025. The longest delay so far has been 26 days, with only one payment being 2 days early. They do not answer my calls or messages. The payment due on 10 Nov this year is still awaited as of 26 Nov. What can I do?

Q: Hi, I went to see an apartment, and the property agency asked for a 1,000 AED security deposit to block the apartment. They told me I would receive a receipt for the payment. Before giving the money, I asked for a sample contract to review the cancellation terms, and it stated: "Applicable Cancellation Policy: If canceled or modified up to 14 days before the date of arrival, no fee will be charged." After one day, due to a change in plans, I requested a cancellation and demanded my 1,000 AED back, as the cancellation was well within the 14-day period. The agency refused and is not refunding my money. Please advise!

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
