Refund of the reservation fee paid to the developer
Hi,
I had booked two villas with a developer and paid them the booking fee of 40000, 20000 each. After which, due to certain circumstances, I had to drop the idea to proceed ahead with the purchase.
Checking with the developer's sales representative, he said it is not possible to get a refund.
What are my chances to get a refund in the above case?
I did not sign any document, just have the receipts of 40000 paid on different dates.

Dear Sir/ Madam,
Thank you for getting in touch with me on this.
Please note that I will have to take a look at the payment receipt which you have for two villa payments.
Have you signed any reservation form or any documentation which has terms written on it? If yes, then mail it for further advice.
As long as the developer has not registered the property in your name then you have a very good claim against refunding the amount.
Please email me the documents on hari@alnassaradvocates.com. You can contact me at 052 9495731 for any clarification.

Dear Sir/Ma'am,
Trust you are doing well.
Further to your enquiry, please be informed that we need the payment receipt and any other document provided by the the developer.
Also, let us know within how much time from the date of the payment of entire amount you notified the developer about your intention to not proceed with the purchase.
If you have not signed any document, stipulating the cancellation policy, then you can validly claim the refund.
Kindly be informed that as a first step, we can send a legal notice to the developer and the sales representative for the refund of the entire amount.
And if they still refuse, we can proceed with filing our claim in the Dubai Land Department.
For confidentiality, you can send us the required information at info@awsuwaidi-advocates.com or you can call us at 045547635. We look forward to hearing from you soon.
Best regards,
